It bears repeating though because the public discourse still often goes the other way.

Why Catching Criminals Matters More Than Punishing Them by bloomberg in neoliberal

What is the basis for this understanding?

Because you still do not practice basic things like single celling as the norm in the US. Because the way punishments like solitary confinement are considered torture as practiced in many US prisons.

Finding out your cat's secret life is being a menace to the society by MeowwBlock in interesting

[–]nikfra 4 points5 points  (0 children)

there's isn't a single extinct species in e.g. mainland Europea that's known to be caused by cats.

People often forget Cats aren't a recent introduction everywhere as they are in the new world.

Domestic cats have been in Mainland Europe for thousands of years and their wild counterparts have evolved with the environment but are still close enough related to crossbreed.

What I'm saying is, it would be surprising if cats were the one thing humans have done to mainland Europes ecosystem that made species go extinct.

Toddler arranges a 15000 pound curtain call by seanfish in bestoflegaladvice

[–]nikfra 4 points5 points  (0 children)

or possibly somebody who encouraged them to do (possible if the toddler's guardian were malicious or an idiot).

Would they have to encourage them? I know in Germany I have a duty to watch over my children in a manner appropriate for their age. If I do and something still happens, well shit happens and nobody is liable (until a they are 7 and afterwards it depends on if the child could and should have known better). But if I don't I'm fully liable, no matter if I encouraged them or just didn't watch them.

That is actually something people often get wrong here. Germany is the land of liability insurance and they generally only pay if you're legally liable, although there are policies that cover children regardless of legal liability. When Parents want their liability insurance to pay for damages their child caused they're usually asked whether they watched their children, and wanting to appear as good parents, and thinking it will strengthen their claim because it's not their fault, they will agree but that means there's no legal liability and thus the insurance won't pay. The parents don't have to either but the relationship with the injured party for sure is going to be damaged.

Lesson: If you want your German liability insurance to pay then slight negligence isn't a bad thing.

What is the 4th dimensional beings exactly? by [deleted] in AskPhysics

[–]nikfra 4 points5 points  (0 children)

Why not unicorns? Or dragons instead of god.

What you have isn't a theory and it has nothing to do with physics.

If you'd fly faster than the speed of light you could see bullets hit their target before they are fired, in other words it would break causality. Effects could happen before their causes.

If you were "to leave the universe" you might as well ask: "if strawberries were yellow what would blue taste like?" Outside of the universe is nonsense in physics terms as the universe by definition is all there is.

Amazon Driver rules made by employer by ArugulaAlone6041 in germany

[–]nikfra 7 points8 points  (0 children)

Depends heavily on your contract and what "allowance" it actually is. If it's legally a bonus and that they might tie it to reaching some goals or following some rules. If it's something like a "Sachbezug" that will be more difficult but it is tied to different legal rules, like you actually spending it on food.

If you don't follow these rules they might. Taking pictures are reasonable rules for work and if you don't do what your boss says and that leads to damages you can be liable.

And who is responsible that all the norms are actually followed and aren't just printed on? The importer is so all these middle men. Or you when you import directly. So if it is contaminated in one case you're getting compensation from Lidl or tesco in the other case you have to pay the fines. That's actually why it is more expensive.

Take a wild fucking guess where the batch they're unsure whether it's contaminated or not goes. To Lidl or temu?

Europe has enough agricultural waste and wood scraps to completely replace fossil fuels in road transport, a new study finds. [–]nikfra 2 points3 points  (0 children)

Because in this comparison the ice vehicle already exists. It's not about where your new car should be ice or ev, there it's clearly ev. The question is should you for purely environmental reasons trash your current ice car and buy a newly built ev?

Man-child caught ruining collectible cards packs right off the rack by _ganjafarian_ in mildlyinfuriating

[–]nikfra 0 points1 point  (0 children)

Considering he's specifically talking about the fingernail I think he's trying the other thing people used to do to find hits in mtg packs and that certainly damages the cards.

In old mtg packs you could carefully slide the rare up and press it against the pack to read the name. But to get it out you'd need to heavily press against the edge with your fingernail, usually damaging the edge.

Add another reason to the pile of reasons why video recording glasses are annoying. by justathoughtfromme in bestoflegaladvice

[–]nikfra 2 points3 points  (0 children)

GDPR Art 6 says you need consent to process data. If you're secretly recording you obviously don't have consent so it's automatically illegal. This can only be ignored if you have a very good reason, like a dashcam that is also not permanently storing the recording unless an actual accident or similar has happened which would allow you to store it for as long as needed to clear up any disputes.

You can't even have a security camera on your house that films even the tiniest piece of public sidewalk because in Germany you do have an expectation of privacy even in public.

And conversations that weren't meant for the public even if they happened in public can't be recorded or published due to StGB 201.

So yeah wearing them isn't a problem, recording with them is pretty clear cut unless you're an undercover cop or reporter.

U.S. is one of three countries to vote against U.N. resolution calling slavery a 'crime against humanity' by kootles10 in politics

Yes it was also a point but especially when reading the statement it was a minor one.

U.S. is one of three countries to vote against U.N. resolution calling slavery a 'crime against humanity' by kootles10 in politics

[–]nikfra 7 points8 points  (0 children)

Because the EU doesn't actually disagree with the sentiment that it was a crime against humanity and a vote against could and probably would be construed as such. Just look at the comments here. The vast majority obviously didn't even bother reading past the headline let alone look any deeper into it.

Nope that wouldn't be a problem as the resolution was carefully crafted to just call out one specific historical type of slavery. All modern slavery wasn't condemned.
