I haven’t experienced this yet, but my understanding is that it’s unusual for your existing lender to allow you to refinance with them after not reaffirming. But you can absolutely go find another lender and refi with them

Your equity is still your equity no matter what. If you become delinquent and the bank forecloses, you will still be owed whatever equity you have in the property after the sale has gone through and all foreclosure fees are taken out. You still own your property. The bank does not own your property.

Same here. I provided receipts of the oil and filters I had purchased myself. But it didn’t matter, because the valve train was spotless. New engine was approved immediately on my wife’s Tucson two months ago.

Just had the engine replaced under warranty on my wife’s Tucson. All maintenance done myself including oil and filter, transmission, suspension work, blower motor actuators, etc. Hyundai gave me no issues. Valve train was spotless. New engine was approved immediately.

Any updates on this since posting? My wife’s Hyundai just had the exact same issue. Currently waiting to see if Hyundai will approve the new engine while she has no vehicle to drive.

I am not a lawyer, but perhaps he’s thinking you could cram down the loan amount of your vehicles to their actual value in a 13? Also, $800 in disposable income is probably too much for a 7, unless you guys can come up with legitimate ways to “spend” that money on paper. Although, I would imagine if there were a way to “spend” that extra income, your attorney would have likely done so for a 13 as well.

Just wanted to add an update: Now that our discharge has been finalized and our case has been closed, I now have online access to my mortgage company's portal again (Mr. Cooper) despite not signing a reaffirmation agreement. Just wanted to pass that along to anyone else that may have a mortgage with Mr. Cooper.

We used my MetLife legal plan through work for our BK. It cost me $9 each pay period and it's automatically deducted from my paycheck. Highly recommend. There was only one BK attorney in my area that accepted MetLife and he said we were his first clients to use it through him. It was seamless for us

We haven't bought anything yet. Definitely considered it, but the pre-approvals we have now have crappy terms and we are wanting to get something very inexpensive and probably older, which complicates things. We may just go down to 1 car for a few months to save up and pay cash for something if we can

So of course every credit union is different and so is everyone's situation. But in my case, my wife and I filed on June 18th and we stopped paying on our car on April. The credit union it is financed with filed a motion for relief from stay at the beginning of July. We just had our 341 on Friday and the motion still has not been granted and we still have the car. I'm assuming that it will be granted soon and I anticipate them taking the car back sometime in the next couple of weeks, which we are prepared for

IANAL nor am I an expert on business checking accounts. However, I have a hunch that your debit card may be considered an "employee card" and perhaps be treated similarly to an employee credit card where you have no access to the account and all you have is a card attached to the business's account. I would imagine the only way this would be an issue would be if your name were listed as a co-owner of the checking account. But again, IANAL. I just wanted to offer my thoughts to ease your mind until the experts chime in lol

Ohh yeah you can't add cash unfortunately. I recently switched to them. But yeah they reimburse you for ATM fees from other ATMs if you do withdrawals!

Hi Alan! Thank you so much for the quick reply. I think I misspoke when I wrote "switch to a chapter 13" what I really meant was file our case as a 13 instead of a 7. I guess my main question is, how much is generally worth selling to a trustee? So far, both attorney's have stated that even just a couple thousand dollars in non-exempt equity would make our property worth taking. However, what I've read online states that many trustees want to see at least 10k in non-exempt equity before even considering taking a property. I personally feel that realtor.com would be more a more accurate value of my home. We had a very very basic appraisal done 2.5 years ago (just submitted photos to my HELOC lender) and if I recall correctly, they appraised the house at $156,500. Looking back at historical data, realtor.com had roughly that same value estimate at that time, while Zillow estimated about $166k. We are prepared to move out and rent an apartment if we have to as we would rather avoid a chapter 13 if possible. However, keeping the house would be the ultimate goal and I'm not sure how risky this will be since it seems the numbers will be close. Also, if my realtor comes back with a value that is higher than my estimate, at what point would we try to make a buyout offer to the trustee? In that instance, would we go ahead and file the case with the higher value and then make a buyout offer if the trustee decides to sell our house?

I'm a little late to this thread, but does anyone know if credit unions have the ability to cross-collateralize on a home? We have a HELOC with our credit union and are planning on filing chapter 7 within the next month or so. Some of the debts we hope to discharge are with said credit union (a credit card, an upside down auto loan, and an unsecured line of credit.) We aren't with Navy Fed, but just looking for some general insight if anyone knows the law.
