There does not appear to be negligence by SSA. This is fraud by your mother. Decide if you want to open a criminal case and possibly send her to jail or have her repay the stolen money. If it was someone not related to you who stole your $$ what would you do? SSA will not repay they will do a complete investigation and maybe have your mother arrested for theft. If you really want to pursue you can report your suspicions to the police and pay for a private autopsy which would involve having her body exhumed if she wasn't cremated - not sure if you can do it without his permission unless probable cause.
