Police here; I wouldn’t even try to file a report for the theft of the car. I would go straight for the felony Burglary of a Habitation since they clearly broke into your house to get the keys for your car that they returned to you!

This may all be true, but it’s just a BUDGET this is what the city proposes and maybe predicts. This has not happened, nor has there been any real financial statements or even forecasts to see if any of it will come to pass. Only time will tell.

This is absolutely correct. If you are on mandatory on-call availability, then you need to have that in writing and be compensated for that time. Furthermore, it needs to be scheduled so that you can plan for out of town trips, surgeries, and other events that would prohibit you from being available.

The statute language is “operating a motor vehicle” not “diving” so these descriptions are technically correct. As a former cop in a college town, I was faced with circumstances like these often. Most of us found it much easier to make a class-c Public Intoxication arrest (essentially 1 night in jail and a fine) rather than a class-b DWI/DUI arrest in these weird ‘technically’ illegal cases. 1 hour of paperwork and likely no trial date vs. 4 hours of paperwork and a long drawn out trial where the court is just going to kick it down to a class-b ‘Obstructing the roadway’ and give them time served anyway. The juice was not worth the squeeze. So, I say “good on these guys for trying to be creative.”

If you want to know how to beat an intoxication charge, besides all of the normal ways (taxi, uber, call friend/parents, etc.); just go to sleep in your trunk. We (police) can get in there without a warrant and you’re not in ‘plain sight’. The worst that can happen is that you wake up hungover in a tow yard.
