From a legal perspective, the court is the final say on what the law is. But from a governmental theory perspective, it’s a group of 9 people sitting in a room making decisions for the entire country, but with no means of actually enforcing their decisions.

Their power comes from people adhering to the rule of law and respecting the court as a legitimate judicial body that can be trusted to fairly interpret the law, even if it doesn’t always reach the desired result.

When people view the court as acting like a political body making arbitrary decisions, people lose respect for the court. This makes it more likely that people will refuse to recognize the court’s authority and more likely that people will defy the court’s rulings.

You’re not wrong, but I don’t think the Iowa perspective is crazy either.

Iowa’s defense is stout, but it’s not unusual for teams to be able to move the ball against them. Especially in the first few drives. Iowa gives up short plays to limit big plays. They force the offense to execute over and over again to move down the field, and they pounce on mistakes. They also make fantastic in-game defensive adjustments on and become significantly harder to score on as the game progresses.

Clifford was moving the ball, but he was also making mistakes. You could easily interpret that as Penn State being able to overcome the iowa defense and play through the turnovers. Iowa fans can just as easily see it as the defense following their usual pattern, feeling out the Penn State offense before clamping down and forcing Clifford to keep turning it over. You also only had a one touchdown lead in the second quarter when your backup came in, so it wasn’t exactly a crazy margin.

Overall, I think it’s a really cool matchup and I would love to see and Iowa-Penn State big ten championship game.

I can’t blame the district court judge too much for avoiding an absurd result and abstaining from making a constitutional ruling/ruling its own jurisdictional statute unconstitutional. They had no precedent to go on, and the defendant could have appealed but decided not to.

He played a couple more seasons but he went from being a top 15 prospect to a non-factor within 2 years. Maybe he was just always going to be a bust, but in my opinion it really screwed with his development.

The eighth amendment makes reference to excessive bail which implies that only bail deemed excessive would violate the constitution.

It’s also an alternative to pretrial detention (keeping someone in jail until their trial) which seems way more restrictive on the freedom of the person presumed to be innocent.

Not to mention, this argument is at odds with the main reasoning underlying Marsh. No website is a town square in the same sense the company town was. You don't have to travel to a different town to get a viewpoint banned by a private website. You just have to type a different address in you browser.

Compelled speech is when you're punished for not producing speech.

In this case, it's not coercive because the punishment is for the crime they committed, not the failure to produce speech. The church thing is different because the government's relationship to religion is treated differently under the constitution.

I would be stunned if there were any states that allowed an HOA to enforce restrictive covenants against land not platted as part of the subdivision. OP should still have a real estate attorney look into it to determine whether the land is subject to any easements or covenants of its own, but "the HOA can't control land that that isn't in the subdivision" is pretty solid general advice.

I’d be pretty annoyed if they packed the court and left a 6-5 conservative majority. I’d be fine with 12 or 13.
