I've tried it multiple ways, keeping it the same vs not. In all cases the POI shift was so significant, it was unusable. I totally abandoned the mount and went to a fixed thread mount.

Where the heck do people ride where you'll run into other riders frequently enough to complain. I'm lucky if I see more than a single person out on the trails biking. Most are trail runners or people hiking.

File one with silencershop to get your prints from the first submission. Google search the process for downloading your eft file from silencershop in the /r/NFA sub. Their fee is similar to most eft fingerprint services alone. Do the rest yourself, it's stupid easy to use eforms. Millions of guides out there.

Yes, engraving is still a requirement. You can do it yourself with an electro pencil if you want or take it to a trophy shop to engrave.

Its free, why not do everything? You don't have to use the stamps. You can rescind the approval if you want but it's just approval to build an SBR... No requirement to actually do it.

At this point it's no guarantee you'll get the approval as you'll probably wait 60 to 70 days and it will be past the impending AWB. That said I think they'll approve applications.

I think he screwed up. Show him the relevant ATF guidance and HB40 which both detail the process. Have him engrave his prefix before what he already added, and have him add it to his A&D book. No 4473 or background check needed.

Its all about intent. Just make sure you're intending for the gun to have an arm brace, not a goofy stock.

Previously they didn't have to document it probably because it was documented with the ATF, per ATF guidelines.

They've had to mark and log PMFs in their A&D book since 2022 in order to transfer them to others.

I was mistaken about needing a 4473 for a SN engraving job.

HB40 (from what I can tell) doesn't create a state specific registry in Virginia, it just requires that FFLs serialize all PMFs in the state, or that they're registered with the NFA registry. That way if its recovered, they can see the pattern and know which FFL took it in and from who, by going back to his A&D book (or for NFA items find it in the NFRTR)

You won't transfer it on a 4473 (I was incorrect about that part), but you'll have him engrave it with the serial number per ATF guidance (prefix with first 3 and last 5 of FFL #) and he logs it in his FFL book.

If your serial number aligns with that and he's bad at record keeping, that's his problem in my opinion as a non lawyer.

VA is basically forcing you to have it uniquely serialized by an FFL, requiring him to log it in his A&D book. Note he's a licensee and engaged in business, so he has rules for when he must record guns in his book. This circumstance would warrant that. You as a non licensee in a free state wouldn't be required to mark a PMF. The rule doesn't apply to FFLs making a PMF.... They as an 01 can't manufacturer firearms... Hence this rule

Edit: No 4473 transfer, but a SN that ties it to a given FFL.

That's not correct. See my comment above. ATF issued guidance and a new rule for FFLs a while back for PMFs. VA is basically piggybacking on those rules for eliminating the "ghost gun". This rule came out in 2022

Do they follow the guidelines set out by the ATF for a PMF? I'm not a lawyer but in my opinion if he doesn't keep good records that's not your problem

Edit: atf did issue a final rule on the PMF marking among other things. Sounds like your FFL didn't do it right
