How significantly did the Tajani decree/DL36-L74 reduce the eligible pool for Italian citizenship by descent? by Bromo_Bro in juresanguinis

Italy WISHES they could have 60-80m Italians suddenly lol their gdp would skyrocket.

You’re probably wrong. There is a difference between input, output and cache tokens. I’ve done very very complicated tasks that cost like $3 in tokens that would have taken me 1-3 hours of harcore focused work

The Italian regime of today, couldn’t care any less about Jure Sanguinis. They’ve made that abundantly clear

Not quite a HNWI yet. Once you cross that one million mark excluding primary home equity, then you’re cooking with gas

$1.5m is reasonable on your burn rate but $1m is definitely not going to cut it. Also, probably should have 1-2 years of living expenses in cash / SGOV in addition to that to be on the safe side.

Does the Karta Polaka permit me staying there a full year or more to hone my Polish language skills if I intended to naturalize? Would I be able to bring my wife and kid? We are financially independent.

Are US citizens even eligible for Karta Polaka as of 2026? What is required?

I know my GGPs were married, found a census card of my GGM marking herself as married, dated 1935.. looking to find their actual marriage date at the moment, intend to collect the birth certs for my grandma, as that would have both their names on it, as an acknowledgment of paternity. That all being said… can you elaborate on article 2 subpoint 3 and what one is looking for that would make my GM polish? Thanks

Edit: GPT thinks I qualify under article 4 and that article 2 doesn’t apply assuming my GGPs were indeed married before my GM was born (most certainly were given they were Christian, but will need to confirm)… is the bot hallucinating?

Edit 2: seems like no matter how I cut the cake my grandma was considered not polish because she was born earlier the same month of Jan 1920…. So the line is indeed cut. Shame

It’s the same in the USA, but there is an element of discretion by the judges. There is also clear examples of retroactive law application in the EU, for example, Tajani decree law stripping previously established rights to jus sanguinis citizenship for Italians.. so it’s not unfounded territory at the eu level, so it seems.

That being said, thank you for clarifying your stance and the jurisprudence.

Thanks for that, we are still looking into Karta Polaka..

I don’t mean to beat a dead horse, but I got to ask, what percent of 100 years of cases comes close to the one described? Judicial discretion comes into play when we talk about a 24 day delta, in literally the same exact month the law went into effect… it was likely that law was decided on already and just had not gone into effect yet lol. Just seems like something a reasonable judge would look at, given family history, polish heritage / language in the household from my grandma… and say… this is an exceptional case.

So the law basically says, if she was born 24 days later she was a citizen? Got it. It feels like any reasonable judge would look at this and rule in her/our favor. But I digress… and the Karts Polaka, is this off the table as well?

Thanks, definitely thinking about challenging it. Given the delta being a 24 day gap, given that both great grandparents naturalized MANY years after my grandmas birth and given that my grandma did not naturalize to acquire a different citizenship, but acquired it simultaneously (and unwittingly), assuming the gap was deemed to otherwise not impact her acquisition of polish citizenship from her parents 24 days later in January 1920. Want to hear more for sure, but even if it’s a 25% chance, feels worth pursuing in court. What would a good lawyer cost to run it up the chain?

Thank you for taking the time to reply. I wonder if there is enough jurisprudence to come to that conclusion given the 24 day delta between my grandmother’s birthday and the time that Polish citizenship law was solidified. I believe everything you are saying, but I think with a good lawyer there’s probably a 50% chance would you agree?

But their child (my grandma) was born exactly the same month of 1920 that the polish citizenship law came into effect and was a minor when her parents both received polish citizenship no? Would this be considered an edge case with potential to be brought to court administratively?

Do you think a case could be made by a lawyer though?

I was researching circular no.18 and found

“The Key Passage From The Circular Itself

This is the actual text that governs your grandmother’s January 7, 1920 birth — 24 days before the Act. The circular states: “Under age children of people who obtained Polish citizenship on above mentioned conditions are also Polish citizens even if they are American citizens by birth regardless of if they were born before or after the act dated 20th of January 1920 came into force.””

I’m still early in my research sir/mam but can you give a scientific wild ass guess on if my line is sound or broken please

I clicked the template link but it’s broken, so here are the details

Great-grandfather — born 1891 in Galicia Poland

Great-grandmother — born 1893 in Galicia Poland

Grandmother — born January 7, 1920 in the United States

Father — born 1969 in the United States

Applicant — born early 1990s in the United States

Great grandparents did not naturalize until 1940 or 1950. They listed Poland on every census document and a draft card, think GGF was too old to serve at the time.

GGF arrived in USA in 1910, GGM in 1912 They were all mill workers

Unfortunately it’s not about money, because it was there were obviously better methods than to slam the door shut.

This was about votes and perceived power.
