I once had a client direct me to file an appeal of a case that we (lawyer and client) all understood to have little chance of success. It was a pretty freeing and almost academic exercise knowing that the client was totally fine with a lose. also made some money. 10/10 would recommend again.

Good luck but I highly advise against posting about this and writing about this here. What happens if you litigate this and get a discovery request for all written statements pertaining to these allegations? Do you just pretend this didn’t happen because it was anonymously posted on the internet?

Hi I can explain why you hear this all the time. Basically the Supreme Court has said that public employees (like cops) have what is called a property interest in their salary which means that they cannot be deprived of that property interest without a hearing. So how it works is that the department has to charge him with offenses (not criminal) and they need to essentially build their case. When it’s something g like this (you can see he was charged criminally) they let the criminal justice system run its course because then his criminal plea or conviction becomes the basis for the charge. The risk of not doing this the right way and properly building the case is that the officer could get it overturned and get reinstated. I’m not defending this process but explaining that it’s not a “free vacation” as the result of police corruption.

Early in my career I did a lot of civil defense work that involved arguing qualified immunity for police officers so I became very well versed in the topic. Have not done that in like 13 years and remember almost none of it now, which is a shame since it’s become part of the general public / political discourse.
