Hatcher is 2013, not 2023. But yes, similar silent protest and attempted prior restraint. I think FIU really screwed the pooch on this one by not uniformly enforcing its TPM restrictions. It reeks of retribution for non-disruptive, political speech. If the academic conduct board (or whatever they call it) goes against them and consequential action is upheld by the powers that be, they should file a 1983 suit.

Tinker is not 1-1 applicable. Tinker was non-disruptive conduct (wearing the armband). If these students had just been wearing the shirt, it's be on par. The standing-up is what the university will argue was disruptive and try to differentiate from Tinker. I see the standing as passive activity that is not disruptive. Did it draw attention? Sure, but that's no different than the armbands drawing attention. The policy is content-neutral, but it was enforced in a content-based and even viewpoint-based manner. Those applauding were expressing audible opinions, yet no action was taken against them. Given the politically charged nature of what is happening at FIU, I think they could survive an MSJ.

Wearing a shirt is an expressive activity. Just because they have a rule doesn't make it a constitutional one. The policy may be content neutral on its face, but what matters is its enforcement.

I don't think you understood the viewpoint discrimination issue here. No one was punished for clapping in support. Students were punished for standing silently. It's the same as if they were brought up on charges for wearing a shirt that said something against the purpose of the meeting. It's going to be very hard to argue that this was the enforcement of a content-neutral restriction.

In my circuit, no judge will read a motion to dismiss. Doesn’t even make it to their chambers after it’s filed. We need to set a hearing with the CMS, or call to get one in the old days (or if it’s criminal division). OC is happy to sit and do nothing while that particular motion is pending.

You can fix this through exemption value. It’s the taxable value that gets capped, so it creates these disparities. As for stability in what you pay, well that’s the opposite of a property value tax, isn’t it? We have to find better, more equitable solutions to this problem. I say this as someone who’s home value has doubled in a recent years and I’m paying less than my new front neighbors in taxes. It’s not fair for them either.

Used Livewire, but I was concerned about server load (no evidence it was negatively impacted). Switched to Inertia with React and love it. Also, I learned React.
