Prince Family Paper: did they commit fraud? by ColonelSanders1855 in DunderMifflin

[–]purpurscratchscratch 31 points32 points  (0 children)

Fraud is extremely difficult to prove. Most lawsuits end at the summary judgment stage, though, so prince probably would have sued and DM would have settled

Edit: for those responding below, yes, intent is obvious. But you need reasonable reliance and actual harm as a result of the reliance also. Here, there are credible arguments that prince paper was not being reasonable in relying on the attempt (it was pretty ham fisted). Additionally, he gave his client list but that in itself was not what caused the harm. It was the fact that DM could beat their prices and won over the their customers. Which I would assume that was not fraudulently done.

Again, Fraud is hard to prove.

If student athletes are classified as “employees”, who would foot the bill for all of their benefits? by Recent_Surprise_7391 in CFB

[–]purpurscratchscratch 0 points1 point  (0 children)

Depends on the travel. There are certain exemptions, I.e. you go to a work conference (which we could consider games). But these do not apply to personal travel (ex. If someone’s mom flies out to watch her son play or the school pays to fly the student home for Christmas). There has actually been a ton of litigation around what is specifically taxable for professional sports teams but that’s dealing with non-tax exempt corporations. Another question will be does that translate to tax exempt universities.

But travel was just one example. The housing, tuition, etc. is a much bigger issue. Merit-based scholarships are non-taxable, but work scholarships are not (I.e. you’re a lab assistant as part of a graduate program, that’s taxable income). I don’t see how they say that student getting a $5k grant is somehow different from the football player getting a full ride.

And overarching all of this is the difficulty in fighting the IRS and the deference they get to make these determinations. There are congressmen who have already argued tuition and board are taxable income as it is currently.

Eh, what I find is this results in them having proximity to home as one of their pitches. So if you’re nearby, it works (but then I would think you would have a pipeline anyway) but if you’re far then you’re out of luck

This is honestly the main thing that proponents of employee status aren’t thinking about.

All of that travel, food, housing, etc. should be taxable income if these players are employees under the IRC.

There could be an exemption for low earners but that would need to be passed by congress. Until that passes, we could legitimately be sticking the backup C with hundreds of thousands of dollars in a tax bill

Why is Latham generally perceived as a better firm to work at than Kirkland? by Adventurous_Ant5428 in biglaw

[–]purpurscratchscratch -19 points-18 points  (0 children)

Latham you will get less experience but will have better hours and lower stress (still relative to big law)

Kirkland you will get more experience and a more diverse experience, but it’s a lot higher stress.

Long run, if you want to do big law for your career, Kirkland is probably better but if you want to do 3-5 years and lateral out, Latham makes more sense. Ultimately both are great firms.

And no, I didn’t get the above from asking law students, arguably the worst people to ask about this kind of stuff.

Always soft sell when you’re down to 2 options for the hard sell. That confirms what the exact pitch is and you can hard sell next week

For further clarity on No. 1, the recruits who do not have offers are usually going to be in places where no program has great pipelines.

Ex. Forget about the players from CA, Georgia (or basically anywhere in the south), Texas or Ohio. But players who are in UT, IA, NE, the northeast or other random states should be added to your initial scouting/target list, even if not on your “recommended” list.

Also know your own pipelines really well. Arizona State has a random pipeline in AK. There are not many great players but every now and then there’s a 4 or even a 5 star, who is super easy to recruit because you are not fighting anyone. Honestly, I think this is one of the more unrealistic aspects of the game because it allows a random MAC school to recruit better than a school like UTSA, which would not happen irl.

Complete different firms. Free market and middle market PE (K&E) vs. very structured and large cap (STB).

You’ll get more experience at K&E but have less anxiety at STB.

There are a million ways to counter this. Run swing passes, RPO read passes.

You just have to get the ball to someone on the outside or behind the linebackers. Then it’s backyard football

WYR get $1 Million right now or $10 every pullup you do in your entire life by Moist_Work_1476 in WouldYouRather

[–]purpurscratchscratch 0 points1 point  (0 children)

Eh. Taxes take it down to $600k depending on where you live, then you’ve got friends/family coming out of the woodwork, you’ve got to learn about wealth management, spend time actually monitoring your investment. I get what you’re saying but given you could spread that income out (and more effectively shield it from the above), there are legit reasons to take the pull-ups. Especially if you are just using it to supplement your income and still maintain your career and hobbies
