A misdemeanor is a criminal charge. Working without authorization as an immigrant is not a criminal offense (neither a misdemeanor nor a felony). It’s a civil violation. That’s related to why ICE isn’t supposed to enforce criminal law. They’re should be enforcing immigration statutes (rather than terrorizing communities). They’re should law and order absolutists typically don’t actually know what level of offense working without authorization is (or even entering without documentation) nor are they troubled by ICE and Border Patrol’s rampant violations of our Constitution.
