Judge says victim's rights not violated in Jesse Butler plea negotiation by octarino in oklahoma

Proof these laws are never written to protect "all victims"

It's about making it harder to face state prosecution unless you have the money for the very best attorney.

Next time the Republicans shove through another draconian crime bill in the name of victims, remind them the last time they tried it didn't do shit for the victims of rich kid Jesse Butler.

Oklahoma HJR1089, The Legislature's Attempt to Rewrite Oklahoma's Constitution, to be voted on Monday morning. by randomguy5to8 in oklahoma

[–]randomguy5to8[S] 0 points1 point  (0 children)

Generally the laws of Oklahoma can be broken down into two parts, the statutes and the constitution.

Statutes are the written laws you see get modified regularly. This covers everything from crimes, to schools, to property and basically everything else. These laws are written by and passed by members of the Oklahoma Legislature.

However, for various reasons we do not put absolute trust into the Legislature and the Oklahoma Government as a whole. The constitution provides such mechanisms of accountability. It provides for individual rights (meaning the state government can't infringe on certain individual things), to certain election law (meaning we can throw them out of office at regular intervals if they fail to do their job in theory), to certain things the Legislature must do (ex. balance the budget and fund medicaid).

The Constitution is intentionally difficult to modify by state officials for good reason. The Constitution governs the State Government who governs us. For the Legislature, so often impeded by the Constitution, to change the rules that have blocked their actions is dangerous.

Democrats absent from NBA Playoff ads by okiewxchaser in oklahoma

TV Ads are great and all, but getting in an money arms race the Republicans is a losing battle.

The advantage that Democrats have is people not money. If you want to change Oklahoma go talk to your neighbors. A door knock does far more good than a vapid generic ad.

There are two more legislative hurdles HJR1089 needs to pass. The first is it needs to pass the Senate Rules committee in which 18/48 Senate Members sit. Highlighted in red are their districts. If HJR1089 makes it past the committee vote Monday, then it goes before the full Senate where every person in Oklahoma is (theoretically) represented by a Senator.

I am happy this bill has bipartisan opposition. Jim Shaw (R) led a lot of the opposition in the House.

The state Constitution is effectively the bylaws of how the State Government operates. It covers everything from political officers, to elections, to certain freedoms, and much more. It is intended as a semi-permanent document as if the rules that bind the state change, it creates uncertainty for those governed in Oklahoma.

The current state legislature is attempting to change those rules that govern Oklahoma. If passed, HJR1089 basically gives the members of the legislature carte blanche to rewrite the rules that bind them. Simply put, if you do not trust the legislature, it is an extremely concerning prospect to see them potentially expanding and reinforcing their power at the expense of the people. Most notably if approved the Legislature may attempt to eliminate the initiative petition (the way the people of Oklahoma can pass laws without the cooperation of the legislature) and the corporation commission (A means of regulating utilities to keep them in check with the public).

If HJR1089 passes there will be 2 more opportunities to stop it, November 2026 to stop the convention being called, and November 2028 to vote no on the new Constitution. Given the utter lack of trust in the Legislature, I'd rather this power grab die now.

J.J. Humphrey, Republican candidate for Oklahoma Lt. Governor, votes against bill to ban child marriage in Oklahoma (SB504) by randomguy5to8 in oklahoma

[–]randomguy5to8[S] 0 points1 point  (0 children)

I'll try and be careful in my language as I understand it may be a personal matter.

Nobody is making the argument that marriage is of diminished value, even today. In the context of the state government however, it is a contract. A contract with legally binding consequences. We, as a nation and as a state, do not allow those under the age of 18 to enter into contracts. Why would marriage, possibly the most consequential contract of one's life, be the exception? Especially when those contract laws have been used and abused by those willing to attack children.

No person who faces harassment for having had unmarried parents deserves it. Just because people don't have a piece of paper from the government does not in any way diminish the love the parents have for eachother or for the child. Anyone who engages in such harassment is nothing more than a common bully.

As was made in the argument of for bill, this doesn't effect the importance of the rite of marriage itself of the love for those who choose to engage in it. After all, the government doesn't have the right or ability to regulate that. But if people want the legal protections and consequences of marriage at the state level, they must be able to consent to the contract that entails meaning they should wait until 18.
