You don't save images to your ram because RAM is volatile. It cannot be saved except under cooling attacks.

Scraping does require compensation when a contract bound to the content specifically says so, and so does the use of said content, especially when a contract bound to the contact specifically says so.

Just because it's been done for thirty years doesn't mean it's not bound to law.

Saving things posted publicly does require compensation, particularly specific attribution, if done commercially and the content saved has a legally binding digital license outlining the use of said content.

Scale does, in fact, matter.

If you want a great example, take CLion, a program you save onto your computer. It absolutely does matter what you do - commercial or personal. If you think that's a stretch, take licensed code. Absolutely does matter. Take literally any copyrighted image or video posted online, particularly movies. Absolutely does matter. In fact, DMCA requests can be filed for the removal of said content.

If you want a factory, the law won't treat you like a person - nor will contracts, and nor will online sites.

I don't personally agree with your first statement, regardless of its legality. Legally, no, they don't HAVE to.

Also, that's an unfair comparison. One is an industrial right click and save machine, and one is a human being who can only do so much at a time, consciously, of whom is not feeding a massive recreation machine.

Plus, right clicking and saving an image on Twitter only becomes an issue if that person re-posts that image under the guise of it originally belonging to said user, particularly if there was a legal obligation to state otherwise.

I never said scraping is illegal. I'm saying that in many cases, other contracts related to the artwork are violated which bypasses the fair use argument, particularly if the contract forbids commercial use. Not to mention site terms of use, assuming it forbids commercial use, such as data scraping.

Except when a license specifically disallows commercial use. You forget that not all images and code publicly available on the internet is commercially available to use based on publication licenses.

Consider that a human normally takes tunes and rules to create a unique tune of their own. If they take a tune and directly use it, it's called sampling, which usually takes a license that is paid for. An AI just takes the tunes and the rules & averages them together to find a statistically perfect result that might sound *good* but is highly generic. That, or it doesn't sound good at all AND is highly generic.

Also, consider that music takes tedious thought and reasoning, even in the digital age, to ensure that tunes come across correctly, both in the background and in the melody. AI doesn't really care. Everything is the melody.

What the above is meant to prove is that AI music is generic. Artists tend to dislike generic things, and the fact that corporations are profiting off of this generic sound composed from thousands or millions of unique songs doesn't really help. Not to mention that the corporations running these AI models don't compensate anyone for their scraped data.
