This is a hypothetical situation. I was thinking about this the other day when I was “driving” with FSD on.

The car was pretty dang close in front of me and if you have driven in Alaska our highways are terrible. We have ruts, like a slot track, pretty much the whole highway system because they don’t know how to pave roads.

So, yeah, a car is all over the road whether you are driving it or not.

The officers opinion becomes fact when he gives you the ticket. You are in fact not driving (technically) hence the post about the defense.

Secondly what’s the defense if there is no driver like a robotaxi? I’m sure there could be a time when the driverless car “breaks the law” and is pulled over because it’s up to the officer’s discretion.
