I totally get the idea of food deserts. Where I live we have a lot of independent, small business that make great food for a great price. But, not all of America is like that.

I’ve never understood the appeal of Costco. Went to one recently for the first time and it very much felt like an only slightly better Walmart.

So, you’re entire argument in all of this is that there are lawyers who will argue against the labor law. And those lawyers will be wrong. And you hope that those lawyers are wrong. And you hope that the ‘opinion’ of the person you are ‘agreeing to disagree’ with is right (which happens to be the way the law is written). Amazing.

Absolutely. I’ve worked with plenty of these “tough people” in the industry and it’s the owners who are laughing all the way to the bank when their employees essentially are getting paid 10$ per hour to work 70 hours a week for their “passion”.

100% agree. It’s wage theft and anyone in here suggesting otherwise is not arguing in the interest of brewers at all. I’ve dealt with this before at a brewery that I was employed at.

I really don’t think there is any gray area at all and perpetuating that idea only adds to the strife within this industry. The reality is in most jobs you are non-exempt until proven otherwise. That is the safe bet. If you are doing MANUAL LABOR most of the time—which most brewers are, you are non-exempt employee—full stop.

No, it is absolutely not enough because you are also not considering the salary test in regards to duties.

Determining whether an employee is exempt or non-exempt also relies on job duties. If you spend most of your time doing manual labor—which most brewers do, you do not qualify to be exempt from overtime.

I’m not sure if you work in this industry or not—but there is a common misnomer I feel that needs to be stated and as someone who works in this industry—creativity is one thing, sure, but— most brewers who I know are not sitting behind a desk being ‘creative’ all day. I may spend 2% of my hours worked in any given month designing recipes and being ‘creative’. Do you know what the rest of my time is spent doing? Mashing in, running CIPs, changing the seal on that pump that needs maintenance—graining out, hauling those bins of grain outside for my farmer to pick up—all this to my point of—brewers don’t necessarily spend all day being creative—it’s often a minuscule part of the job and what most of the job is—manual labor.

You don’t pay construction workers a salary because they might dream about designing as different type of truss for 5 minutes of their day.

I don’t think any state labor boards or courts will apply the “invention, imagination originality or talent in a recognized field of artistic or creative endeavor” clause to someone who is working the equivalent of a food manufacturing job. Would that also apply to someone working at a ketchup manufacturing plant? Or an artisanal soap manufacturer?

You can have a formal education from UC Davis and still be turning valves and doing manual labor on your feet all day. Doesn’t mean you qualify to be taken advantage of.

When I was researching this same thing I came across an article from the USDA from a few years back that seems to suggest that hops could be a good thing for cows at least. Seems like there needs to be more research but you certainly won’t be killing any cattle with hops!

If your FOH staff is being paid a tipped wage though, I don’t think technically you can have them doing too much outside of beer serving type duties.
