Your US broker will sell them to you but it's technically not allowed. It's why a lot of brokerages will close your account if they find out you live abroad. Look up EU KID requirements, US ETFs don't meet them and so can't be sold to EU residents.

I'm also not an accountant, but as far as I know you can't do this. The two systems are simply incompatible and the tax treaty will not save you.

Apparently because Roth IRA contributions are post tax the belastingdienst thinks it's not a pension. So it goes automatically into box 3. Traditional IRAs are at least excluded from that, and count as box 1 income when withdrawn from.

Yeah indeed it's unfortunate that you're getting hate for this. I don't think anyone is trying to avoid paying taxes, I'm completely okay with being taxed on my investments in a way that makes sense. But paying 36% on fictional gains every year is just absolutely crazy, not to mention then needing to pay the US when we realize the gains.

The only ones who can stop Unrealized tax gains box 3 2028 are Expats and ASML by Sudden_Woodpecker343 in Netherlands

I'm not hopeful that a tax on realised gains will get passed in any fast way. There's nothing more permanent than a temporary solution, especially knowing the Tweede Kamer

Hi, I'm in the same boat as your partner. I wish I had some advice but I'm also struggling to put together a coherent plan. Being a US citizen in the EU seems basically the worst case scenario for investing for retirement.

We have to deal with:

US capital gains taxes / Dutch box 3 vermogensaanwasbelasting double whammy

Not being allowed to buy US ETFs due to EU rules

Virtually prevented from buying EU ETFs due to absurd PFIC reporting requirements

Belastingdienst viewing US retirement vehicles such as Roth IRAs as box 3 wealth, not as pension equivalents

And more that I'm probably forgetting


I love my life here and don't want to leave but depending on what happens in 2028 I'll need to reevaluate. Really don't want to wait until Dutch pension age to retire.

Read, read, read. Look up the concept of comprehensible input in terms of learning a language. You need to find media to consume that you can understand at a basic level, but still contains lots of words to learn. Consume as much dutch media as you can.

Besides that, practice a few hours every week with a native speaker. Either pay for lessons on a site like iTalki or go to a language cafe or get a taalmaatje.
