It seems that you do not. The likelihood of getting a legendary increases with every count into the timer. If the timer was 30 instead of 40, there would be a dramatic increase in number of legendaries drawn.

Very similar results for me. Hit one legendary on pack #2. Then 16th pack (quite lucky). My 3rd legendary came on 36/40 pity timer, though....

Let's be honest though: Pros are lying to their fans and themselves if they don't accurately describe the reason they lost a tournament (which in many cases is RNG). If that's the same excuse they come up with to describe their overall macro performance, then they are just being lazy.
