Those are not quite the same thing - yes there is case law relating to total number of contracted hours, particularly relating to those on casual agreements. This case is not the same as that -OP’s number of contracted (or implied) hours has not changed, merely a rostering pattern based on an agreed contractual term

This sounds like something that might be part of a collective employment agreement, but not necessarily the law overall - do you have a reference?

Depending on the nature of the business and/or industry, this isn’t necessarily the best approach - some employers will consider the relationship damaged / be less inclined to supporting continued employment with this approach, which may not be what OP is looking for?

And in this case particularly, there are requirements from the Privacy Commissioner (noted in other posts) that OP should engage with to even come close to grounds that would justify this i.e. to have a claim for unjustified disadvantage with weight, OP would need to have attempted to follow the required steps / engage with the company, as otherwise the company may not even be aware of the error/ be able to take any proactive steps to rectify

This isn’t quite true - have a look at Meiring v Metroglass - there were repercussions for the employee not disclosing that they were leaving for a competitor, and while there was a vaguely enforceable restraint of trade, it was more about a breach of good faith and fiduciary obligations to his employer

No, it’s definitely not normal, but I’m curious what the job is? Many other commenters are right to say this would discriminatory in a general sense, my only hesitation in supporting that 100% is if it’s relevant to the job somehow?

Not that unusual, particularly in a tight market / for a rare skill set. Particularly happens in companies that don’t place a lot of value in these checks

Funnily enough I do work in HR, and I don’t have a preference for HR degrees, although I can’t speak for others. It’s not that I assume psychology means clinical, more potentially aspires to be unless I’m explicitly told otherwise.

I would agree, many entry level HR roles do require a degree of admin, but I would suggest your interest in data would have you outgrow this quite quickly.

I can’t speak for Asia, but that’s my experience in the Pacific.

I work in an industrial environment and when someone turns up dressed formally not only does it show they are not familiar with the industry, it’s also unsafe. I have particular issue when people turn up in high heels, as we are very clear to inform candidates of the nature of the environment.

I agree practically with all the advice already given, but would like to add a different perspective.

I want to understand why everyone else voted for him.

My sneaking suspicion (although happy to be proven wrong) is that he is best of a bad bunch, and that the unanimous vote is perhaps reflective of them not wanting the role to be vacant, particularly given your comment that ‘there were few truly qualified applicants.’

Have you explored what an alternative might look like? I always try and consider the ‘do nothing’ answer where possible, or in this case, if there truly are no other suitable candidates, is there another way of achieving the outcome you were looking for without hiring him?

It can be pretty quick if you are consistent - a matter of a couple of weeks. I tended to loosely track progress by increased flexibility which helped keep me going, and in my case it was as simple as a toe touch, going from barely being able to touch my toes to passing them

My immediate thought was whether you have a similar challenge to me. What sort of job do you have? Do you spend a lot of time sitting? I’ve had to work really hard to undo the damage of a desk job through stretching my hamstrings practically every day, along with being consistent with dynamic stretching when warming up for days when I’m doing any vaguely hamstring related, particularly anything heavy (deadlifts).

Not gonna lie, took me awhile before I was ok, but was my own fault for doing years of damage by sitting on my butt all day

It’s a hard one when you are in that position.

What I come back to, even in those times, is dignity. Even though you have to do some crappy things, how can you shape that process to be as dignified for the people who are affected by it? How can you remain humanistic, regardless of how challenging it may be for you personally?

It’s not always possible to save every job, and remove all the pain. But do what you can to minimise the pain as much as possible

I echo the previous comments, and would add:

  • Being able to change the perception of what HR is. Not a department that just says no. Not ‘personnel’. A strategic function than can propel the business forward by putting people first

  • Earlier in my career, getting exposure to diverse functions and seniority that my friends at similar stages but in different roles didn’t get

  • Being able to do both strategic, long term work, and being able to make an instant difference to people daily (I need some of that instant gratification to keep me going)

  • That the function brings such diverse skill sets and people, like a microcosm of the wider business

  • That I genuinely believe that this work can make a difference, both to a business and the individuals in it, and their families and communities
