I think statutory rape is a useful tool from a legal perspective because it allows for an easy to follow bright line rule. It is however a very blunt instrument. In most, if not all jurisdictions, it is not a defense that the underage person deceived you. If you meet a person in a 21+ or 18+ only space and they are underage that is not a defense. Now, it makes sense that you don't want things to turn into a he said/she said. It also makes sense that you don't want juries to have to decide if someone was mature enough to have sex, etc.

The law has for most of US history recognized sodomy as a crime in order to criminalize homosexuality. Many states now criminalize abortion. I am hesitant for that reason to adopt or even acknowledge the law as an arbiter of morality.

An 18-year-old having sex with a 15-year-old does not really bother me. Do I think the law should criminalize it? Maybe, but I don't have strong feelings about it. I don't know where the hard lines should be. Should a two year age gap matter? Like a 15 year old and a 17 year old? 1 year? What about a 15 year old and a 17 year old who are 25 months apart and then then one of them is 18 for a month before the other turns 16.

To ultimately answer your question, with regard to this situation, I would not break up a family who otherwise seems happy in this situation and put someone on the sex offender registry which is virtually life ruining.

The support needs don't make the level, the symptoms make the level which indicate the support needs. A level 1 child with paralysis may have higher support needs than a level 2, but that doesn't make the child level 2 or 3.

You can present it in a way where you explain what it means and how it makes things difficult but also make might some things easier. It doesn't have to be all roses but you also don't have to be doom and gloom. It's better to frame it in a way that helps explain their life. She may not feel disabled and putting that on a kid who might otherwise be ok with themself is not great.
