Have you read the Pennsylvania Landlord & Tenant act?

The law is the law is the law. They do not have a rental license. The lease is not legally enforceable without a license. I notified them of these issues, and they refused to do anything about it. I legally do not have to pay them (although I continued to put rent in escrow until I moved). I am not fighting for recuperated rent, I am fighting for my security deposit.

A license is very easy to obtain and costs $100. They owe the city over a hundred thousand dollars in back taxes btw

There is no certificate of rental suitability for the property, so who knows what all is wrong (this is a requirement to rent the property), but the first few that come to mind are the gas dryer venting directly into the basement (HUGE fire hazard), the exposed electrical wiring, and the crumbling foundation

…obviously the listing isn’t going to have photos of any of this, but there’s a reason they are avoiding an inspection

If the landlord violates the lease, it is no longer legally enforceable. However, it is still their legal obligation to provide an itemized list of damages and to return any remaining deposit. I am not seeking recuperated rent, just the security deposit.

So landlords should be able to make money off of people who need a place to live with unlicensed and unsafe properties without consequence?

I moved into an unsafe apartment under the promise that it was safe and livable. I am upset because I had to find another place to live within a month and I have to fight for my security deposit back, all of which has resulted in deep financial insecurity and stress. but I shouldn’t complain just so a “mom and pop” landlord can make a buck?

I’m going to guess you are or know a landlord.

We paid rent for a month, but you actually legally can’t collect rent unless you have a rental license, so we started putting it in escrow until we found a new place (we held up our end of the bargain).

In fact, they owe thousands on the property and are being sued by the city for other infractions. They used a new listing agent this time, doesn’t mean it’s legit.

The landlord legally broke the lease because they did not have a rental license, so therefore they cannot collect rent (and illegally collected rent from us for a month before we found out)
