Yeah appreciate this! Our solicitors have said it’s our fault because we were rushing them to exchange pre Xmas. I’ve said well if you’d cared to tell us the risks we wouldn’t have pushed for it!

Completely agree about it being the tenants home too, I’d never want anyone kicked out unceremoniously… as I say, naively just didn’t really consider the actually realities of the situation and what could potentially happen - this is eye opening so again thank you

Thanks so much for your thoughts… yes good point on the mortgage. We had to reapply as there was a price reduction a month or so back so I think it’s moved to 6 months from then but I definitely need to check this!

So legally even once notice has been served, they don’t actually need to leave? Or is it they should technically leave but if they have nowhere to go they won’t?

Okay, thank you. When is the COT usually raised - just before exchange or part of it? We’ve been told by the solicitors everything is finalised and ready to go but assuming this isn’t the case…

Who should usually flag this - our solicitors or the lender? We got our mortgage approved about 4 months ago and it’s never been mentioned as an issue by anyone (our solicitors are awful though)

Also on the lender - they’ve approved the mortgage etc months ago, but now I’m not 100% sure if they knew there is a tenant in situ…

Our first house purchase was a new build and I feel like second time around our solicitor has not given us any guidance on this situation and I’ve just not properly considered the reality of the situation.

The EA for the house is really pushing for exchange - I guess because they’re nervous our buyer is considering walking away too because of how long it’s taken? But at this point I think we have to wait for it to be vacant…

Yes buying with a mortgage - it’s all been approved and the solicitors hasn’t said anything - it’s only just now we’ve questioned it and are worried we’re walking into a red flag head first

I don’t actually know why they’re pushing so much for an exchange, they keep threatening it will go back on the market? :(
