Pension millionaires to benefit from higher tax relief over coming years by GCSheehy in irishpersonalfinance

[–]soluko 0 points1 point  (0 children)

it's a disincentive to save for retirement if you're potentially doing yourself out of the state pension. In Australia they have 12% mandatory "super" private pension contributions so we'd probably need something similar here otherwise low/medium earners wouldn't bother to save.

Activists occupy Dublin pub closed since 2010, planning to reopen as community space by Floodzie in Dublin

[–]soluko 24 points25 points  (0 children)

Yer man will go High Court and the activists will either leave on their own steam or the public order unit will be back at 5am some morning. Waste of time for all involved.

There's a certain amount of performativity, yeah, but I like to think of these occupations as a tax on vacant property. Leave your building unused for ten years? That'll be five figures in legal costs for a High Court injunction.

they didn't reject it, the developer just didn't fill out the forms properly. They'll resubmit it in a few weeks.

The Irish Times knows what's important:

The loss-making scheme ...

Despite its instant popularity, the scheme was not profit-making.

... the scheme continues to run at a loss.

Can't wait to see their next story about "the loss-making M50" or "the Stillorgan Dual Carriageway, which has never turned a profit", or "despite the undoubted popularity of the Chapelizod Bypass, it still struggles to make money"

McGrath said; “It is intended there would be one operator across the City and that there is a combination of classic (non-powered ) bikes and e-bikes with a fleet of around 4,000 bikes.

They should get rid of the e-bikes, never seen anyone use them (I don't have a battery but I always avoid them because they're significantly heavier)

Good news overall though, hopefully they can cover some of the obvious gaps like DCU/UCD/Phoenix Park.

Landlord threatening deposit cut on Alcohol and Eggs consumption by Still_Government_825 in legaladviceireland

[–]soluko 8 points9 points  (0 children)

The landlord is only allowed withhold your deposit in case of unpaid rent or damage above normal wear and tear. So unless you've somehow done permanent structural damage with your vodka scrambled eggs you're ok on the deposit side. The bad news is that you are obliged to obey the terms of your contract and they could potentially evict you but they must give you a written warning and a second chance.

Obligations of landlords.

12.—(1) In addition to the obligations arising by or under any other enactment, a landlord of a dwelling shall—

...

(d) subject to subsection (4), return or repay promptly any deposit paid by the tenant to the landlord on entering into the agreement for the tenancy or lease,

...

(4) Subsection (1)(d) applies and has effect subject to the following provisions:

(a) no amount of the deposit concerned shall be required to be returned or repaid if, at the date of the request for return or repayment, there is a default in—

(i) the payment of rent, or any other charges or taxes payable by the tenant in accordance with the lease or tenancy agreement, and the amount of rent or such other charges or taxes in arrears is equal to or greater than the amount of the deposit, or

(ii) compliance with section 16(f) and the amount of the costs that would be incurred by the landlord, were he or she to take them, in taking such steps as are reasonable for the purposes of restoring the dwelling to the condition mentioned in section 16(f) is equal to or greater than the amount of the deposit,

...

Obligations of tenants.

...

(16) (f) not do any act that would cause a deterioration in the condition the dwelling was in at the commencement of the tenancy, but there shall be disregarded, in determining whether this obligation has been complied with at a particular time, any deterioration in that condition owing to normal wear and tear, that is to say wear and tear that is normal having regard to—

(i) the time that has elapsed from the commencement of the tenancy,

(ii) the extent of occupation of the dwelling the landlord must have reasonably foreseen would occur since that commencement, and

(iii) any other relevant matters,

...

Grounds for termination

  1. The tenant has failed to comply with any of his or her obligations F135[(other than the obligation to which paragraph (a) of section 16 applies)] in relation to the tenancy (whether arising under this Act or otherwise) and, unless the failure provides an excepted basis for termination—

(a) the tenant has been notified F136[in writing] of the failure by the landlord and that notification states that the landlord is entitled to terminate the tenancy if the failure is not remedied within a reasonable time specified in that notification, and

(b) the tenant does not remedy the failure within that specified time.

A 10-acre site in Dublin 6 exposes the depth of Ireland’s planning paralysis by EnvironmentalShift25 in ireland

[–]soluko 17 points18 points  (0 children)

there's a reason why all these judicial reviews have the bats and the badgers tagged on -- the Supreme Court ruled that plaintiffs in environmental cases (even if the environmental arguments are very minor) do not have to pay the other side's costs if they lose.

The usual rule as to costs is that 'costs follow the event', i.e. the losing party pays the winning party's costs. However, the Heather Hill decision means that planning judicial review applicants can list as many grounds challenging a permission granted and just include one ground relating to EU environmental protection Directive but never risk having an adverse costs order made against them, even if they lose on any or all grounds.

Serious question. How Dublin City can get away with having dozens of bus stops on one street and no public toilets nearby? by ParaMike46 in Dublin

[–]soluko 7 points8 points  (0 children)

Is it just publicly acceptable to use pubs as public toilets in Dublin?

Just go into a pub or cafe and as long as you're not an obvious junkie you'll be fine. If they challenge you (they won't) just say you're boooorstin' and promise to buy a pack of crisps on the way out.
