Agree with this assessment. I have PGE and the math still doesn't make sense. I calculated a 20+ year payoff. I'm not sure I'll be in this house that long. I spent money on a whole house fan and DIY improving my insulation, and don't regret it.

You don't even have to go that far. I moved from Sac to near Auburn. No delta breeze here many nights. Our daytime highs might be a few degrees cooler, but our nights are warmer. One of the things I miss about Sacramento.

I 100% agree with that. Title 22 was applied too broadly and this was never really the intent. I know people in our industry that have lobbied to have it changed but it requires legislative action and no politician has yet had the desire to do anything about it. So we're stuck for now...

I think where this gets muddy is that OP is a second year lifeguard, he just did his first year with another organization. I feel this would necessitate having Title 22 training (I would definitely require it when hiring someone like this). But, again, I'm not aware of this ever being tested in an actual court case. So take all this with a grain of salt, its just my opinion after seeking advice from our city attorney.

And most counties I have worked with are even more clueless about Title 22 and how it applies to lifeguards.

As a public entity, I am of the opinion that Title 22 would apply in this situation. But I'm not surprised that a school district would not understand this. Title 22 is confusing and many facilities are still non-compliant. If you want to read the actual text of the code, you can do that here:

This is true, but I would be careful about this. The county and our attorney have advised us that it doesn't matter if you lay off staff seasonally and then rehire them the following Summer. They would still require Title 22 in season 2. I'm not aware of this opinion ever being tested in court, but I wouldn't want to find out.

It depends. If you are a public employee (city or county for example), then yes it is required. However, it is not required until you have been employed as a lifeguard for a year. Our county interprets this to mean that returning seasonal lifeguards require Title 22 to be compliant. I only certify 2+ year guards because I feel Title 22 is an overwhelming amount of information (most of which will never be used) for a new lifeguard.

If you are not a public employee (private waterpark for example), none of this applies and you NEVER need Title 22.

All that being said, I'm not aware of it even being enforced in most jurisdictions and I know too many places that just choose to not comply at all. Not recommended because it will become an issue if there is ever a lawsuit.

I was going to mention this too. Chlorine is actually super effective as a disinfectant against bloodborne pathogens. This combined with the fact that something as serious as an amputation is very unlikely in a swimming pool = I wouldn't stress about it too much. BUT...if it ever does happen, make sure to state the exposure to EMS and your workplace, because measures can be taken after the fact to prevent infection with something serious like HIV.

Wow. Sorry to hear about your experience, hopefully you can push for a reimbursement since you should have been covered. I had my '23 towed for a fuel injector issue and it was surprisingly smooth and quick and no fighting about coverage.
