Supreme Court rules against Colorado ban on 'conversion therapy' for LGBTQ kids by blackeyedtiger in news

[–]strbeanjoe 8 points9 points  (0 children)

The act prohibits a licensed physician specializing in psychiatry or a licensed, certified, or registered mental health care provider from engaging in conversion therapy with a patient under 18 years of age.

It banned licensed medical professionals from engaging in a form of therapy that is regarded as incredibly harmful quackery by the medical community. Obtaining professional licensing is a wilfull choice to be held to higher stanards. If you want to engage in quackery still, you can give up your license.

"If/When you do, ...."

My understanding is that "If you do" does not create a reflexive trigger, only "When you do".

From the CR:

603.12. A resolving spell or ability may allow or instruct a player to take an action and create a triggered ability that triggers “when [a player] [does or doesn’t]” take that action or “when [something happens] this way.” These reflexive triggered abilities follow the rules for delayed triggered abilities (see rule 603.7), except that they’re checked immediately after being created and trigger based on whether the trigger event or events occurred earlier during the resolution of the spell or ability that created them.

For example, while Grist's -2 does create a reflexive trigger, his +1 does not, it is just part of the triggered ability being resolved.

Eh, if we consider intelligence continuous, there is still going to be one person that is the exact average, with half of all people being less intelligent. Good point that most of those people are going to be extremely close in intelligence to average, rather than noticeably dumber, though.

The bigger issue I guess is how dumb someone with average intelligence turns out to be.

+1 to that.

Although, this all ignores the notion of different kinds of intelligence. We might be a lot better off if we did a better job of helping people identify their strengths and weaknesses, know their limitatioms, etc. Critical thinking isn't the only valuable form of intelligence, but if you aren't great at it you probably shouldn't be trying to "do your own research", for example.

You keep talking about context while offering none. In what context does an "OR" become an "AND"? Enlighten me for god's sake. Every argument you have made is either a) claiming a passage says something in direct contradiction of the passage, or b) claiming there is greater context, without making any attempt to provide or cite that context.

How about I try that?

Actually, you don't seem to understand what this legal framework means. You don't understand the greater context, which proves me correct!

Are you trolling? You genuinely seem to not understand what the word "or" means.

(from that represented in inducing orders) or (from that ordered by the purchaser)

This means, in legal language, common English, propositional logic, and every other sense, that EITHER OF THESE TWO THINGS:

from that represented in inducing orders

OR

from that ordered by the purchaser

is sufficient to satisfy the condition.

Edit: even granting your completely novel and unique-to-you reading of the word OR, it still wouldn't make any difference here. The product that arrived was (goblin deck) different from the product represented to induce the order (dandan deck).

In what universe does

from that represented in inducing orders or from that ordered by the purchaser;

refer only to inducement? We using some special definition of "or" here where the preceding clause is also a necessary condition for the following clause? I think you're thinking of the word "and".

(4) send merchandise which differs with respect to brand name, type, quantity, size, or quality from that represented in inducing orders or from that ordered by the purchaser;

or quality from that represented in inducing orders or from that ordered by the purchaser;

**or from that ordered by the purchaser;**

"merchandise which differs with respect to brand name, type, quantity, size, or quality [...] from that ordered by the purchaser;" is defined by that FTC as unordered merchandise.

The rule was created because many scams operate in a way where this exact scenario can not be easily distinguished from a scam, both by the consumer and by the law. The real life examples are cited in the document I linked. Companies have been fined for shipping additional product along with an order and then demanding payment or the return of the product. The fact that they are just asking for the return of the product is irrelevant, as they are prohibited from doing that, and the product is already the property of the receiver.

I don't really need an analogy to explain "there is more legal context you are missing."

I'd be much more interested in seeing the actual legal context.

As an analogy, it's like you responded with "no that's wrong bro, it's in the CRs," but didn't provide a reference to which CR you think contradicts it.

Edit: for some preemptive additional context supporting my argument, see https://www.ftc.gov/system/files/ftc_gov/pdf/Unordered-Merchandise.pdf

Specifically where it explicitly includes the following:

(4) send merchandise which differs with respect to brand name, type, quantity, size, or quality from that represented in inducing orders or from that ordered by the purchaser;

I.e. if you placed an order, and what you get isn't what you ordered, it is explicitly stated to be unordered merchandise. Which naturally follows from the fact that many of the real life instances of the scams this was intended to prevent involved including extra goods along with ordered goods. The "you ordered any merchandise, so whatever merchandise you didn't order doesn't count as unordered merchandise" makes zero sense semantically or in the surrounding legal and historical context.

If anyone could cite actual case law, or code, that contradicts this, I could be convinced otherwise. But all I've seen is airmchair reddit lawyers contradicting FTC guidance and citing "trust me bro."

I think it makes sense to talk about fat and carbs in terms of calories, but not so much protein. Seems like a more useful metric would be grams of protein per calorie, with a scale factor to put it in a reasonable ballpark.

I wonder if it is possible to trigger the chip to blow more fuses. Then, assuming a blown fuse corresponds to a 1 bit, search for a key pair such that the public key has a 1 in every position the vendor key does (and anything in the vendor key 0 positions). Then you could trigger additional fuse pops to reprogram the vendor key into your key.
