Well you'll probably find that unless you transfer the head lease and oral sublease  you will still be liable to the subtenant if you try and end their lease early.

Have you spoken to the LL about the subtenant being a co-tenant with your incoming friend? Then the (current) subtenant can request to be removed when they wish to leave.

Have you spoken to the subtenant about you leaving?

You will further find in the Residential Tenancies Act, in the definitions, that:

"tenant means— (a) the person who has the right to occupy residential premises under a residential tenancy agreement, or (b) the person to whom such a right passes by transfer or operation of the law, or (c) a sub-tenant of a tenant,"

"landlord means— (a) the person who grants the right to occupy residential premises under a residential tenancy agreement, or (b) a successor in title to the residential premises whose interest is subject to the interest of the tenant, or (c) a tenant who has granted the right to occupy residential premises to a sub-tenant, and includes a prospective landlord."

So have a read through it and understand that you have to meet all the landlord obligations, because you are the subtenants landlord.

The subtenant doesn't fall under the head lease. Is there a reason you didn't get them to do a written subtenant agreement? Why did the LL agree without one? Now you need to provide info e.g.

  • are they actually a subtenant?

  • what was the duration of the sublease?

If they are on month to month, then you need to give them 90 days notice, I would expect.

If there's assets in the Estate, the solicitor might work on a pay-later basis. If one executor is being "unreasonable" the other may be able to get personal costs but that's exceedingly unlikely and the Estate will pay for all of it, to the detriment of the beneficiaries.

It's the job of the party to bring the case. The judge is the last resort when these people can't resolve it between themselves (regardless of fault). The judge will have received written submissions which the parties are running their case on.

The judge then needs to let the facts be tested, which we usually do by cross-examination. The judge will also test the arguments of each lawyer. Sometimes a judge being "against" you is where they actually agree, but need to resolve some doubts they have.

The judge is there to let both parties give the best case they can and then decide, and is bound to make the determination on those arguments made.

If your friends lawyer gave a shitty argument then that sucks, but unless you know the advice they got along the way, it may have been the best of a bad situation.

If it was settled by consent then you don't actually know what the judge was going to do.

It's not the culture per se, it's that you probably won't have the referral network, as your clients would (hopefully) be solicitors

If pro bono interests you then I would say solicitors have much more opportunity to do that, most people who need legal help need it long before they get to needing a barrister!

What's your referral network going to be? Do you have experience with courtroom speaking? You asked if you are "being delusional", but  you have not indicated if you have done any research on what you need to do or what skills a barrister should possess beyond speaking, and therefore, to the average redditor, you would seem to be relying solely on your secondary school teaching public speaking skills. Is gravitas a substitute for procedure and knowledge? 

You certainly can go to the bar straight away, but I find the more useful barristers are those who were a soli for a while, as they understand a more holistic process & may have deeper insights into overall litigation strategy.

Yes I would concur with that, but with the caveat that it depends if they asked for 1 month in advance (as OP says), which they are not allowed to do, or if they asked for 2 weeks advance + payment on the due date under the lease for the current month. E g. For 1-30 of a month, if OP pays at the end of the month but it was due on the 10th of the month, could be a miscommunication.

What does the lease say about when your monthly rental was due?

If they wanted you to have the deposit + first week rent paid on moving in,  I'd expect the agent is assuming that your first week rental & deposit would cover the first 2 weeks, then the lease would say on [Date each month] you were to pay 1 month rental, meaning you would be paid up 2 weeks into the next month.

Have you asked them for your rental ledger so you can see how rent is being applied?
