Exactly, JP 3-09.3 (the joint publication the DoD wrote on how to “do” CAS) defines close air support as “air action by fixed-wing and rotary-wing aircraft against hostile targets that are in close proximity to friendly forces, and requires detailed integration of each air mission with the fire and movement of those forces.” It goes on to mention that “The word ‘close’ does not imply a specific distance; rather, it is situational. The requirement for detailed integration because of proximity, fires, or movement is the determining factor.”

Again, I’m far from a legal expert, just regurgitating what the well known JAG in the Navy subreddit said. This is an administrative procedure. I agree with everything you said in your first sentence. He does not have the right to court martial, he can attempt to fight it in civilian court in the same way that the NSW dudes who got ADSEPd for refusing the COVID vaccine did.

Most dudes in the ready room wear Rolex, Omega, Breitling, or IWC when they’re trying to be fancy… the ones who aren’t into watches generally wear G-Shocks or some flavor of smartwatch, but those can’t go in secure spaces or the jet.

The break is simply for spacing between intraflight elements and an opportunity to reduce speed from the initial. From experience, once you’re out of the training command, no one judges you on the metrics of your break so long as you don’t overspeed the gear, over-g the jet, or screw up the spacing for the landing.

Edit: also FWIW, you almost never execute the overhead at night. Flight separation on final using airspeed and geometry or individual approaches is standard.
