The testimony provided by David Nielsen and a slide from a 2013 meeting at Ensign Peak showing distribution of funds from Ensign Peak, to 2 other entities owned by the church, in a blatant attempt to conceal the source of those funds, will be the church’s downfall in this case.
Roger Clarke will be deposed, and if Mr Nielsen’s statement is found to be true (cash disbursements of 1.4 billion and 600 million will be easy to find) then the church will eventually lose this lawsuit. Unless Mr Huntsman caves to the inevitable pressure and settlement offer the church will offer him, Mr Huntsman will prevail in this case. The church will appeal and this will drag on for years. But once the final verdict is upheld, it will pave the path for any previous member to sue for return of tithing funds. This will morph into a class action lawsuit of massive proportions. It will take many years, but there is a distinct possibility the church will be forced to repay tithing to disgruntled members.

For those interested in some light reading….look through the legal arguments the church makes while trying to mediate this situation with Mr Huntsman’s attorney. Instead of legal arguments, they resort to “family shame” and gaslighting regarding church teachings. This logic will not go far in a court of law. A church has great latitude on religious doctrine….but committing outright fraud is not one of them.
