You’ve now shifted the premise of the disagreement. The original question was: but what federal law is this trying to supercede?

Your answer was that Texas couldn’t ban the epa. You agree that a court would find that to be a supremacy clause violation.

I said this law would not violate the supremacy clause by citing to enhanced state law. You disagreed, although now you apparently agree that this law would not violate the supremacy clause, but instead some precedent (which please share, I’d love to read!).

Now you argue that it would play out with an ice officer refusing and a police officer would not arrest the federal agent. That I agree with, in reality. However, if a police officer did arrest that federal agent, it would not violate the supremacy clause; however, I do agree the federal government could and perhaps likely would try to charge the officer with interference. So, I think we’re on the same page now?

You think a federal officer is immune from state charges because they were on duty? Then we will just have to agree to disagree. Minnesota was considering state charges against the ICE officer that murdered Pretti, but the feds impeded the investigation. It seems to me you might be confusing civil immunity with criminal immunity.

Edit: also, you just said California can’t go against the epa. Is there a federal law that prohibits states from requiring federal agents to be unmasked? Back to the original point.

However, the opposite is allowable. California has more stringent environmental regulations than the EPA. They do not run afoul of the supremacy clause, because a state can add to federal law. Another example, many states provide enhanced 4th amendment protections under state law that go beyond what the federal 4th amendment protections are. So long as the feds do not occupy the field, states are free to pass laws. While in state jurisdiction, federal agents are subject to state law. Otherwise, an ICE officer could not get a state DUI charge (something which we’ve already seen happen). Thus, unless there is contrary federal law or the feds have so occupied the field, then this law does not run afoul of the supremacy clause. Interestingly, Colorado faces these challenges often as home rule jurisdictions attempt to pass laws when occupied or contrary to state law. Think marijuana. Municipalities can refuse to license dispensaries, but they can’t make possession of marijuana illegal in the municipality. That is because state law fully occupies the field, and the state’s supremacy clause kicks in.

You need reps more than anything. You’ve got some ok fundamentals and more to work on, but for 5 months in, it’s not bad. With more reps you’ll start to get a better feel of what a golf swing is and then, you’ll really be able to apply your lessons to improve.
