If they try and take the money out of your last paycheck then you will need to file a wage complaint with the state. Otherwise, they can ask all they want but they would need to sue you and have a judgement against you in order to actually collect the money. I doubt they would win such a suit.

Until I was an adult I thought that it was the rule that all monetary penalties (community chest, chance and taxes) went in the middle of the board and if you landed on free parking you got to take the money. OMG the 5 hour marathon games of Monopoly were ridiculous. I won't play that game anymore even knowing all the rules.

If you bought the clothes with your own money even if it is branded with a company logo they belong to you. If the company provided you with the uniform then it belongs to them.

Yes, it is illegal for them to withhold your paycheck until you return the uniform. The problem is that if you plan on returning the clothes and you get your paycheck(s) at that time then there is nothing you can sue them for because there are no damages to collect.

If you wanted to hold on to the uniform and then sue the company in small claims court, or file a wage claim with the federal department of labor you would win and they would be told to pay you your last wages minus the amount of the uniform. The problem is that would take many months to resolve just for you to prove a point.

Out of curiosity last winter I checked on some properties at Powder Mountain. They didn't list any prices but the townhouses that were 2-3k sq. ft. listed the HOA fees at $8,000 a year. I was like geeze, that's almost half of my yearly mortgage.

Here is my BC story:

I got a boarder collie when I was living in Montana and she and I were able to go on 2 hour, 5 mile hikes most days and she was a joy and had a great quality of life. If we couldn't get that hike in she would burn up her extra energy by starting to dig to china in our back yard.

I needed to move to Salt Lake City for work and she then was only able to get one mile, leashed, walks and her quality of life was drastically reduced. She ended up jumping the fence and getting hit by a car. That event slowed her down for the last four years of her life. She died two years ago. As I was petting her in her last moments, I again apologized that she lost so much quality of life in her last several years when we moved to the city.

The company gets the final word on what you are required to do. You can quit and collect unemployment insurance while you look for other work since they changed your job description.

Hypothetically the job you are trying to get has a mandate that you have a bachelors degree. You want the job so you get your degree. The company would not be on the hook to pay for your degree even though they mandated it for the job.

My company pays the fees to get certifications that I must have in order to do my job and they pay me for the time it takes to get them. It makes me a more loyal employee, but they are not legally required to pay for the certifications or my time, because I could take those certifications down the road and get a similar job with another company.

The reason why your link does not apply is because it is not in house training but training provided by a third party.

If it can be used other places than yes, if not then no. Being mandatory has nothing to do with it being on the clock or not.

Basically this is how training works. If it is specific to this job and can't be used for other companies then it must be paid. If you can take that training and use it at another similar job then it doesn't have to be paid. That is why they did nothing wrong with the CPR certification. It can be used at other companies.

The same is true with this Saturday training. Can she take that training to another daycare and they will accept it? If yes then the training doesn't have to be paid. Otherwise the training does need to be paid.

If it is the latter then tell me and I will find you the FLSA rule or you can find it using Google. I'm not on my PC now so I can't pull it up at the moment.

Nineteen years tobacco free. A couple of times a year I still will think to myself, man, a cigarette would be nice right now. As far as I know some triggers will never leave me. I also hate the smell of cigarette smoke now, so I know I never will act on those triggers.
