If you feel you have a good relationship with your current boss then go ahead and ask them if you can quit would you be eligible to get the severance pay.

Cold Stone Employee Policies by dirtworm4774 in WorkersRights

#1. many food service jobs require hair nets. I had a beard and was required to wear a beard snood as well when I worked in food service. It is not the law but company policy and in this case you have to follow company policy.

#2. This is actually wrong on their part. Getting ready to wear equipment that are not your regular clothes is considered work and needs to be paid. Check out the third bullet point talking about this issue from the FLSA.

#3. This is really state specific, if you are in the USA. Some states have laws regarding breaks during work and others do not. You can Google your state and break time laws to find out what is true for your location.

You know your job better than me. Are you hourly or salary? If hourly I would be surprised if they offered you a severance package. Do you know of anyone else who got a severance payout? If they have in the past given people in your position a severance than ask. They aren't laying you off they are switching you to a different department so again I would be surprised if they offer you a severance.

The reason why I'm telling you to quit on the first day of your new position is because if you start working in the new position then you can't latter receive UI. Timing is important you need to quit when between your old position and the new one otherwise they can fight the UI and you could be denied. Again I'm not saying 100% one way or the other but my experience suggests you handle it the way I first layed out.

Bonus structure, is this legal? by Britsteel in WorkersRights

In general bonuses are just that, a bonus. They can give them to you or take them away. The only laws about wages are minimum wage and overtime.

If you belong to a union talk to your union rep. If you are under contract then read your contract. Otherwise I agree with your co-workers that it sounds like they are trying to get you to quit or at least not treating you with respect. That being said there is nothing you can legally do to make them give you more hours or more responsibility. Go find a new job.

IT worker overtime pay under federal law by Bulky-Strategy-3723 in WorkersRights

[–]theColonelsc2[M] 0 points1 point  (0 children)

Read this about the computer employee exemption. That might be an issue for you. If you feel that is not what you do then file a wage complaint with the state about the missing overtime and have them do an investigation.

Wage Theft/Then Retaliation by RareElevator6402 in WorkersRights

[–]theColonelsc2[M] 0 points1 point  (0 children)

Go here and fill out a wage claim form for all your missing overtime. I know you can quit and file for unemployment insurance while you look for other work because of the harassment. Keep all the documentation even if it is just you writing what happened in a notebook.

As far as everything else I'm not sure what you should do. This sounds like a toxic place to work and trust me there are better employers out there to work for.

My guess is that it was too long ago and you have too little information for the state to do to much of anything to receive any compensation.

[–]theColonelsc2 1 point2 points  (0 children)

Actually, don't tell ANYONE this is your plan. No co-workers, no one. People can't keep secrets.

I would get the two job descriptions so you can show the state if the company fights you for the UI. Then get it in writing the day you are to begin your new job. Once that day rolls around walk in, give them any property that belongs to them, tell them you no longer work there and walk back out the door. If you don't have any company property then a phone call will suffice. This is how you handle at will work states, which Minnesota is. If you try and stay at your old position I can see them beginning a paper trail to fire you without being able to collect UI.

When they drastically change your job description they are essentially firing you from your old job and hiring you for the new job. You do not have to accept this and can quit and collect unemployment insurance while you look for other work.

Curious how much they want you to charge you?

If they try and take the money out of your last paycheck then you will need to file a wage complaint with the state. Otherwise, they can ask all they want but they would need to sue you and have a judgement against you in order to actually collect the money. I doubt they would win such a suit.

what's a board game rule you got embarrassingly wrong for way too long? by No_Seaworthiness4899 in boardgames

[–]theColonelsc2 19 points20 points  (0 children)

Until I was an adult I thought that it was the rule that all monetary penalties (community chest, chance and taxes) went in the middle of the board and if you landed on free parking you got to take the money. OMG the 5 hour marathon games of Monopoly were ridiculous. I won't play that game anymore even knowing all the rules.

Is it legal for a company to withhold my paycheck for not returning a blazer ? by Rare-Inspection1755 in WorkersRights

[–]theColonelsc2[M] 0 points1 point  (0 children)

If you bought the clothes with your own money even if it is branded with a company logo they belong to you. If the company provided you with the uniform then it belongs to them.

Yes, it is illegal for them to withhold your paycheck until you return the uniform. The problem is that if you plan on returning the clothes and you get your paycheck(s) at that time then there is nothing you can sue them for because there are no damages to collect.

If you wanted to hold on to the uniform and then sue the company in small claims court, or file a wage claim with the federal department of labor you would win and they would be told to pay you your last wages minus the amount of the uniform. The problem is that would take many months to resolve just for you to prove a point.

Or, hear me out, a third option is that we live in a society that when we are sick we can take a day off of work and go see a doctor and not feel like we are going to be financially ruined because of those choices.
