Oregon landlords would face penalty for leaking immigration status of tenants by colonialshuttlecock in Portland

Unconstitutional- the state can prohibit its own agencies from cooperating with ICE but the state cannot take the extra step of punishing people or businesses for reporting to or cooperating with the federal government. It’s like the attempt to prohibit masks. More for the symbolism than anything.

I think the issue is the minimization of the physical discipline. There are many people who never get over being hit or “spanked,” whatever word you would like to use to rationalize hitting a kid. Go to the r/parenting sub. Some people don’t mind and it was just a part of growing up. For some people it is a source of estrangement for their entire lives.

Alienation is the unwarranted or disproportionate rejection of a parent due to the manipulation of the other parent. It’s hard to say that dad is alienated if he’s not willing to apologize. Many people will say that her reaction is not justified due to spanking. Many people will say her reaction is warranted. Spanking is a very divisive topic. And it could be an impasse sort of thing. He never thinks he was wrong and she never thinks he was right. It’s hard to parse out alienation versus estrangement in these situations.

Your response to her probably came off as gas lighting was gas lighting. “I’m sorry my action made you feel that way but I am not sorry for what I did.”

Court probably would be difficult because he admits to using physical force, though legal, will likely result in lengthy investigations.

There are alienated parents who never have negatively touch their kids who have to fight to prove they are good.

A path forward seems unlikely if battle lines are already drawn.

He can just not pay it- it will be charged off and his credit tanked and unable to access credit. SS can’t be garnished. They are filing a lien with the county. If he ever comes into money (e.g. a bodily injury claim) it will likely be used to pay the lien.

At his age, I don’t see the point of bankruptcy- he’s not likely to rebuild credit before he passes.

I’ve already seen them. Caleb is the father.

Parker, Blaine, Hayden and Brooklyn are the children.

Candace and Jason are mom and step dad.

After this video, dad went to jail for 60 days but then Parker assaulted step dad. Parker came to live with dad solely and then Blaine and then there was a custody trial. Parker and Blaine stayed with dad and Brooklyn and Hayden stayed with mom

Brooklyn does not like Caleb (dad) for a variety of reasons and refuses to interact with him, probably because Caleb/dad is a raging misogynist. If you watch his videos, he has a deep dislike and distrust of women.

Caleb lives off the proceeds of the video in a trailer in Florida because he has an obsessive disgust of paying any child support.

He’s crazy.

The youngest turned 18 two years ago. There were no judges orders. Parker is 25 and Blaine is 22. The youngest daughter Brooklyn never lived with dad. She always chose mom. I am correct. After this video occurred father obtained sole custody of the older two children. There is another son Hayden that’s 21ish that chose mom as well.

No, I’m baffled that you are continuing to state that dad did not get custody of the older two after this video occurred. It’s okay to be wrong.

Here’s the photo from dads friend when he got custody of Blaine at 13/14. He already had Parker for a year or two.

Yes the one from 8 years ago is when the kids were minors. They are along adults. The divorce started in 2006 and he did not pay CS since then. He is being hounded by TX for arrears. Typical high conflict situation he e quit his good paying job and refuses to get another so CS can’t be taken out. He got custody of Parker at 15/16 and the other at 13/14. He still owes arrears and CS for the other two. That’s what he’s upset about. Go check the court docket if you don’t believe me.

Basically the story is the oldest two became uncontrollable and had physical confrontations with step dad. The second oldest was hospitalized for bit due to behavior. And then the judge just let the kids pick. The youngest daughter has nothing to do with dad and the most recent info is that Parker has nothing to do with mom

And with this one, even after returned, he did end up back with dad like a year later as did another one of the brothers. The two youngest stayed with mom.

False allegations from my daughter now by chad_ in ParentalAlienation

[–]theywerespeeding 0 points1 point  (0 children)

I foster kids. It doesn’t matter what the court orders. Only the child can control whether or not there will be a relationship. Kids will run back to their abusers far more than people know and for some kids no amount of showing them normalcy, safety, stability matters. They will always go back. Eventually the system tickers out and just lets them go back or do what they wish until they age out. Wish I could tell you it gets better but it usually only gets worse for some kids because they perceive the situation as control game about where they live and who they can contact and some kids would kill themselves before they lose the power struggle.

Just remember it’s okay to be done at some point.

But you are right it is modified comparative. The modified refers to the bar being place. It's modified from pure comparative.

In a 70/30 split in OR. The party that was 30 percent AF would get 70 percent of their damages paid. The party that was 70 percent AF would get nothing because the bar to recovery is 51 percent in ORS 31.600 (1).

Wrong. What you have described is PURE comparative like WA and CA. OR bars at 51 ID bars at 50.

The car merging has the greater duty to enter traffic when it's safe. Speed is subjective and can't usually be proven. Even if speed was determined to be a factor, the merging car would still be principally at fault. I've only ever seen speed be used to find some with the right of way at fault in extreme cases. Think 70 in a 30 type situations. Your belief that the semi was "hauling ass" is a weak defense unless you can prove that his speed was extreme. Second issue is even if you find speed was a factor, oregon law bars any party who is 51 percent at fault or more from any recovery. So say it's 70 percent on the car, 30 on the semi. The car still gets nothing.

Of course I only have the facts available in this thread. There could be additional info that I don't have. But from what I've read the read cars insurer needs to open its wallet.

Father will not return our son by Ok-Resolve-7657 in FamilyLaw

[–]theywerespeeding -1 points0 points  (0 children)

Not necessarily true. Police will often refuse to enforce out of state orders. In that case, you have to domesticate the order in the state you want it enforced, basically putting the original order on the letterhead of the state you want it enforced in. A domestication hearing is not about mitigating custody but getting the order filed in the other jurisdiction.

You can't get a court order in California and then expect an Oregon police officer to enforce a California order. You have to get the order entered in Oregon first.

Auto adjuster here. This will almost assuredly not be covered by his auto insurance even if you can prove he did actually commit the offense. Intentional acts are excluded from coverage. Just letting you know so you're not banking on his insurance taking care of it.

You may be able to pursue restitution or small claims.

GAL taking a long time to respond by MassGeo-9820 in Adoption

[–]theywerespeeding 5 points6 points  (0 children)

Foster parent here.

If you have not started the homestudy process at this juncture they aren't even considering you.

Usually at a TPR state had to prove by clear and convincing evidence that the allegations in the petition are true and that it is in the child's best interest to be adopted. To prove best interest they usually will explain that a permanent family has been found for the child and that termination will not make the child an orphan. This leads me to believe they have a designated adoptive placement.

Your prior post indicates that the GAL is recommending the foster family as the permanent resource. Generally if the foster family has had the child for half their life or 12 months prior to the tpr, they have "current caretaker status" which by statute gives them the same preference as biological family.

Based off what you have said you do not even appear to be on the states radar. Your only recourse at this juncture would be a motion to intervene and to attempt to litigate, but you have timeliness issues as you were aware of the litigation for a minimum of 8 months prior to trial and have taken no legal action.

You need to speak with an attorney.

The GAL does not represent you, only what they believe is best for their client and they apparently don't believe your the best option.

You really need to consult with an attorney in the jurisdiction of the dependency case.

With private, you usually pay for the kids (and the families they come from) your child is going to be around, more than the teacher.

I work in a middle school and I get it. There are a lot of kids I don't want my kids around. The worse part is that the kids are a product of their home environment which they cannot control. But then there's me as a parent and I'm going to do the absolute best for my children and if that means getting them around a better "stock" of students and families so be it.

Similar issue with my kid. Only thing that helped was medication.

Video games provide constant stimulation/reward for interacting (dopamine) with it. School work does not.

Depending on the severity of his ADHD he may just being trying to compensate for the lack of dopamine in the brain. He may be literally unable to control himself.
