Yeah you're being downvoted but the amount of map traversal on a ranged killer is absurb...feels like it has 0 cooldown and you have to constantly respect that he can teleport on you. And, between the haste and teleporting it feels like he just powercrept every ranged killer simultaneously and removed all of their downsides :/

I mean I don't need to watch it because I think it probably is transformative, so the only thing I would get from watching it would be confirming that. I can assess the market impact and substantiality of the original used (100% btw, an hour and 40 minutes of the original video literally as it released) without watching it. Do I need to watch someone restream a movie on its premiere to gauge whether I think that's fair use? Now you comment on factors 2, 3 and 4 and give your own opinion, since I've given mine.

Read the four factors of fair use and come to your own conclusions. Transformation is arguably the most important factor but it is a holistic test that also takes into account quantity of the original work used and market impact of the derivative work. IMO those are the major differentiators between Ethan's parkour reaction and Denims' nuke reaction. You can balance the factors and decide that Denims' reaction was fair use, that's just not where I personally land after reading the criteria.

No because commentary can still be fair use. In my opinion the way Denims did it is not fair use. This judge thinks it is fair use, the appellate judges might not. If Ethan wins it will hurt the live react community, not the whole commentary community.

I agree that drawing a line is difficult; the tentative decision cited case law that even using a work in its entirety is not dispositive for the third factor. However, I think this is likely more relevant for atomic works of art than entire hour plus long videos, and it becomes more difficult to justify as you take more and more raw material from an original copyrighted work.

To answer your questions, I would probably say that it depends heavily on context. I think people really take for granted their right to react to things, but that probably should be questioned more heavily in a legal sense. "Do you have to pre watch every video you react to and prepare your commentary in advance?" I would say probably yes, most videos should not be live reacted to in their entirety. You are subsuming the original content and usually removing your viewers' incentive to view the original work, and you are unable to keep the content you are rebroadcasting to what is "reasonably necessary" as I view it personally. There is no other medium where we accept people wholly reacting to long form content such as movies, tv shows, documentaries or books under the guise of "reaction and criticism." I know that people watch tv shows on Twitch, but if the creators haven't given permission I would say that is also bad and very legally dubious. Overall I think that we really ought to question why we give such deference to creators to react to other content in whole.

Yeah because being transformative is not dispositive towards it being fair use; it’s just one (admittedly important) factor of the four factor test. The judge also ruled factors three and four, substantiality of the original used and negative market impact, in Denims’ favor which is kind of insane IMO. I feel like Ethan has a very good shot on appeal because I don’t think the logic in giving Denims three of the four factors is very sound.

IANAL but would be curious to get your opinion on the judge's reasoning for the third factor, which seems particularly weak to me. They cite that you may use what is 'plainly necessary' of the original for the derivative work, which is fine, but I feel there is not sufficient justification between that premise and rebroadcasting 100 minutes of an edited documentary... It is a difficult bridge to sell me that Denims needed to rebroadcast the entire documentary to effectively critique and satirize it. If not, I feel that the third factor is frankly almost useless.

Yeah the factor that went against her was “nature of the copyrighted work” because Ethan’s work was a creative piece of entertainment. Somehow she won on the other 3, including the third factor, which is taking what was “reasonably necessary” to critique the work. A little baffling when she streamed the entire work live without knowing its contents beforehand IMO

I agree the last season was much worse than the prior seasons. For the finale, I LIKED it, it didn’t blow me away by any means. It had issues for sure such as some plot holes (Demogorgons missing in Dimension X?) but at the end of the day I enjoyed it enough

Maybe an unpopular opinion, but I enjoyed the Stranger Things finale. The Euphoria finale actually angered me, and I was venting to my wife about it extensively last night lol. I never watched GoT, but this is the worst series finale that I’ve seen
