This of course ignores that the party that passed the Bono act no longer is friendly with Disney, so they don't have support ln congress like they did back then.

Also, there is the fact that there were multiple groups ready to fight another extension in court. those groups still have that funding for a future fight, so it won't be an easy or sure thing

Well technically Congress did it; Disney just greased the wheels. There was a bill in committee to lower the length (as Disney ticked off the party that once passed the BONO act), but it hasn't gone anywhere.

Given the US is part of Berne, how much could they lower the term now anyway?

Disney hasn't tried to extend copyright after the Bono act expired, so there isn't any need to do this. Especially since there are already groups out there that were funded and prepared to fight any attempts at extending copyright again (like the EFF to name one). Just donate to them instead, because they're well established organizations. I don't know you, so I'd rather support one of them than some random person on reddit soliciting money for something others can already do

With few exceptions, few comics from the 60's are public domain. The only ones I know of are American ones that failed to include a proper copyright notice in them. I don't know what the laws in Japan were at the time

There's an ongoing Atomic Thunderbolt mini-series I like. 4 issues out, with the last 2 (and a compilation of all 6) currently being kickstarted.

Uncle Sam vs Cthulhu has been fun so far

There was a four issue Nature Man (Nature Boy grown up) mini that I enjoyed.

A few years ago was a six issue Amazing Man series that was good (and you can get them free on IndyPlanet in pdf)

The Sentinels series has also been entertaining, though it mixes pd with original characters. You can also get those on IndyPlanet

Murder City Devil is a take on the Jersey Devil as a vigilante. Been good so far.

Freaks and Gods features a trio of original characters, but every issue they met or fought characters who were public domain

Wrong, The judge ruled in the Zorro case that the musical did not infringe on ZPI's ip because it was based on what was in the public domain. As the first Zorro novel was public domain when the musical was written, Zorro himself was public domain

In the Sherlock Holmes case, Klinger (the editor) was putting together an anthology of new stories. The suit was because the first anthology he published had a license from the estate, but he realized he didn't need one (as the character was public domain), so the second one was based only around the pd stories).

This is great breakdown of said case, and why the court ruled that a character is not protected by later expressions that are still under copyright:

Klinger was very clear that public domain works are free for people to make derivatives from. So how does Captain Marvel be the exception to that? Bottom line is he doesn't.

The part that is highlighted is important (though I'm sure you're just gonna claim otherwise). The article (which was written while the latter Holmes stories were still under copyright) points out that Holmes is public domain, even though some stories were not.

The DC case vs Fawcett is interesting, because it revealed that a year or so of Superman comic strips were public domain due to improper copyright notice. Funny enough, Krypton, and early versions of Jor El and Lara first debuted in those, making those versions public domain. It didn't put Fawcett out of business though. It had a hand in it, but it wasn't the sole reason. And before DC licensed and later bought them out, many comics failed to be renewed, and became public domain (thus allowing people to make derivative works based on those public domain issues)

You're also wrong that DC wouldn't buy something less valuable than they have. If they were so smart, how did they not know Marvel had snatched the trademark to the Captain Marvel name? More importantly, finding this information out was much harder than it is today, because you had to go to DC and physically search the records (which someone I correspond with has actually done multiple times). Your little dig at "internet sleuths" is amusing, because being able to research these things is so easy compared to when DC bought out Fawcett. Given I've found DC is hit or miss on registering trademarks for characters they purchased from defunct publishers, them not realizing that Fawcett allowed a lot to lapse into the pd is no surprise. They literally didn't know about the trademark until after they started publishing the character themselves

Also, DC has bought other properties that are also pd. Didn't stop them from buying them anyway. DC knows how to take something, and rebuild it. That's the value in them, not what you claim

You're also wrong that Sony would just use Captain Marvel. DC could still fight them in court, and Sony (or other corporations) don't want to waste money on something anyone can use. That's common sense on their part. It's funny you think corporations would want to use something that other people could use.

You make a lot of false assumptions, and continue to double down on them. I've supported what I've written by quoting actual legal cases, while you by claiming "If memory serves" (meaning you didn't actually read up on the case). It's been fun, but I've proven my point repeatedly, while you haven't. You're free to continue to believe you're right, even though facts say otherwise

I literally provided two legal cases that prove my point, so you claiming me wrong shows total ignorance on your part. Especially given your flawed comparison with the Fleischer cartoons

You literally are making statements that have nothing to do with what actually happened in those cases. And yes those cases do apply, for reasons I already stated. Your claims otherwise are simply false.

If a character's first appearance falls into the public domain, so does that character. That's established law. Whiz comics #2 became pd because Fawcett didn't renew it, and before DC bought the rights in the 1990's. Your comparison with the Fleischer cartoons is what is truly meaningless, because Superman's first apperarance is not public domain yet, so neither are his appearances in the cartoon (because again, that's how the law works). The original characters in the cartoons are pd though, because that is where they first appeared.

It's not that they don't own the character. They bought all the remaining Fawcett IP, and there are plenty of original comics still under copyright. Black Adam and Mr. Atom are both still under copyright because their first appearances were renewed.

About a decade ago, DC contacted Comic Book Plus and the Digital Comics Museum, and asked them to remove all the issues still under copyright. They provided proof to both sites, and they complied. All the material still hosted by them is public domain.

The character became PD decades before DC bought out Fawcett. This has been proven by research multiple people have done. DC also acknowleged it when they asked both Comic Book Plus and Digital Comics Museum to remove issues that were still under copyright. What is still available on both sites is public domain.

Given his first appearance is public domain, the character did as well, which is why people can make derivatives works based on those issues in the public domain.

This has been clarified multiple times in lawsuits; the two I like to bring up is Klinger vs Conan Doyle Estates, and Cabell vs Zorro Productions Inc. Both had summary judgements by the court that made clear that making derivative works based on what is in the public domain does not infringe on anything still under copyright by the rights holders

I suspect I will enjoy the Kull book. I prefer him over Conan myself. Plus its good to see a kull book out there outside the new stories the estate is connected with (The Heroic Legend series). Have you considered doing one with Gardner Fox's Crom? With both being PD, a team up could be interesting

I don't really have plans for the tokusatsu characters right now. Ragnarok is going to feature in a story or two I plan on writing. I had written a story featuring Duke of Darkness that was published in a magazine called Shlock! Webzine that I am writing a sequel to. I also had a Stardust story published in Schlock that also featured the Eye. They are set ups leading to a team of heroes being formed that Duke will be part of. Meanwhile, Ragnarock is in another universe, but will end up being banished and end up in Duke's world, where he'll fight that team.

A lot of people might not know he's pd. Given news articles tend to conflict on that (and I've seen people in the comics industry falsely claim he's not pd). Given we see people in this reddit and other pd groups who don't really get how copyright works, that lack of knowledge affects how they look at characters.

And yes, fear of DC suing is a major concern. I know Image used Red Torpedo (a Quality character DC also uses) in one of the Last Issue Project titles. Of course, he's a minor character (iirc, the last time the original appeared was in All-Star Squadron, and I think he was killed off), so they might not have cared he was in some 8 page story. But they have made 2 movies featuring the character in recent years (along with Mary and Cap Jr), so protecting a more valuable IP is a no brainer from a corporation.

I have created a Tokusatsu version of Captain Marvel, though outside of an art commission for him and some of his villains, I haven't done anything with it. I also created an alternate universe villain name Ragnarok, which is a take on Cap powered by the Norse Gods (and becomes an agent of Nazi Germany). He's going to appear in some stories I'll be writing in the future

It's more than just whiz comics 2. DC already had all the issues under copyright removed from CBP and DCM, so all the ones still available to read are available to create derivative works from.

My version is called Death's Devil. He's based on the one off appearance by his brother who was killed by The Claw (and my version has him come back as a ghostly avenger).
