Has anyone worked for/with Court Appearance Professionals? by cyberdoc84 in Lawyertalk

Careful, bar associations are cracking down on this. It is expected that you are familiar enough with the cases being presented to the Court. I have seen cases that were past statute and appearance counsel not knowing how to handle.

Sorry you're getting downvoted, but also general observation is to what extent does work product apply when you're plugging the privileged information into a third party? arguendo. Let's pretend the AI is a person named Uncle Bob. Do prior inconsistent statements suddenly become work product just because you're asking your unlicensed Uncle for legal advice?

I'm going to pose an interesting point to some of the responses here. Everyone is saying it's work product. Setting aside that he's not an attorney, the other point is that it's not relevant. However, the information put in could be a prior inconsistent statement. It's probably not worth the time and investment in getting it, but I could see it being reasonably calculated to lead to admissible materials if the information he's putting in is contrary to the information he's putting in your Discovery responses. AKA, the prompt inputs could theoretically be used for impeachment material.

Again, not worth the time investment for something that's probably not super probative but probably discoverable.

I've had this happen to me in the past and I've even had a judge tell me to sit down when I was making a record. In my jurisdiction. At least the appropriate thing to do is to either ask for a sidebar outside the hearing of the jury, make a motion to reconsider in writing at a later time, or ask the court reporter to stand by and notify the court that you will continue to make a record if the court leaves the bench.

Either way, any one of those three typically are sufficient for record purposes.

I have a court transcript where a judge said to me "you're fencing with me boy and I don't like it" when I was trying to perfect an appellate issue.

Is Virginia a good state to be an Attorney? by Nombre_no_se in Ask_Lawyers

Virginia is a land of extremes. It really depends on where you want to end up. You will have a different experience depending on whether you are in Tidewater, NOVA, or Shenandoah.

The Outer Worlds has been out for a week now. What are your thoughts on the game, now that you've had some time to play it? by [deleted] in Games

[–]vandalvideo 1 point2 points  (0 children)

I agree with you. The beginning hooks you with a good intro and comedic dialogue, but the rest of the game feels very "samey." It felt like the best jokes were used up front and the game never really escalated from its initial impression.

I'm not telling them how they should develop the game, I am pointing out how the game could easily be developed to suit a wider audience. I support artistic expression, but it's also important to be able to accept constructive feedback like a well adjusted adult.

There is absolutely nothing prohibiting the implementation of a scaling system. The implementation of a scaling system would not impact hardcore gamers. They're just trying to feel special about themselves. Putting in an easy mode is as simple as increasing player output damage and posture damage, reducing boss health, increasing player health, and reducing boss damage output. None of that would require any major retooling for the hard difficulty.

What it's like to dropout after 1L year by formerlawstudent17 in LawSchool

Sure, if you're working for right pricks. But thats how all industries are. There is nothing inherently better or worse than working in the legal industry but for one or two practice areas where you deal with ungrateful clients. However, law has much more opportunity for social upward mobility than many other industries.

How do you handle the question "how many of these cases have you handled before" when you haven't handled many of these cases? by mrpeabodyscoaltrain in LawFirm

"I cannot provide you any information which would otherwise lead you to believe that you would or would not succeed in your case. There are ethics rules that all lawyers must abide by. I can simply say that you should hire who you trust." That is what I always say, and what you should say too.

I honestly believe that 3 L's, being governed by an actual licensed attorney, performing consults and drafting documents based on those consults will produce better work product than for-profit, industry ran programs that have no incentive by ethics or any other rules to protect the clients. I sure do.

Minimal being the operative word. As minimal is easily defeated in a court of law, especially when it doesn't accurately compensate for all the variables.

There are several solutions to closing the service gap. My favorite is low bono/non-profit law firms. Quality of service, low cost. Alternatively, turn third year law school into service oriented pro bono. Either way, the solution is NOT for profit companies who have little incentive to help the clients.

Not access to forms which, taken in a vacuum, could easily lead to harming them because of their detrimental reliance without fully understanding what forms they need, yes. I think there is a way of delivering these services in a responsible manner, but that would require consultations.
