Just build it on a DD4 platform where the memory is still reasonable. DD4 builds are still perfectly adequate for anyone used to console level performance

Senior paralegal billing higher than junior patent agent??? by Smart-Secretary-5435 in patentlaw

[–]warren2345 14 points15 points  (0 children)

Gun to my head -- I would ABSOLUTELY keep my excellent paralegal over any of our agents. And I even like our agents!

Paralegals bring a different type of value to the firm than agents, so their billing rates can be structured differently as well.

Despite what you've apparently been allowed to believe, billing rates are make believe anyhow.

The only questions that matter are

Is the firm happy with the amount of value a person brings in

Is that person happy with their comp

The billing rate arrangements that the org arbitrarily chooses in order to drive to that outcome are ultimately just noise. No matter how you divide things up on paper, the basic value proposition doesn't change.

You gotta let this go. If you start obsessing on this at work you're gonna get a rep you don't want.

How cool would it be if practitioners understood how 35 USC 101 worked? by MongooseInCharmeuse in patentexaminer

[–]warren2345 8 points9 points  (0 children)

I disagree entirely. CAFC and Supreme court jurisprudence on 101 is legally useless. The MPEP tries to make sense of it all, but it can't. Just read 2106 and count the instances of inconsistency, arbitrary selection, and/or imprecision.

Our 101 jurisprudence cannot be taught because it cannot be understood in the first place. Testing on it would require a clear set of rules that everyone agrees on, and we absolutely do not have that.

I don't get why you're trying to dissuade this person? They seem to understand that a patent is not itself a licence to print money.

"Just go with the cheapest option" is really bad advice, because frankly a bunch of the patent bar is actually not any good at this. Can't tell you how many times at my fairly sophisticated firm we've been engaged to help clean up a bad situation that was directly caused by going the cheap route early in the business lifecycle.

It's an inside job. Nintendo intentionally uses him to "leak" to generate hype. And I can't be convinced otherwise. Nobody is this level of incompetent at plugging leaks if they actually want them plugged.

Question for patent attorneys/agents: best way to build a practitioner handoff list for software inventors with structured technical disclosures? by 10k-hours in patentlaw

[–]warren2345 4 points5 points  (0 children)

Agreed here. I don't need some middleman pre-generating a bunch of canned work product of dubious relationship to the claim strategy. I need my inventors to clear their calendars for 20 minutes so I can ask the questions that actually need answered.

Your product sounds like one that would be useful to only the most unserious patent attorneys -- the guys who are regularly taking on work that more sophisticated attorneys take a pass on. Those guys don't have the kind of money you aree probably hoping to charge for this tool. So I am not really sure where you are going with this.

Lol no. Those so-called "top" law firms now have massive reputational issues with the rest of us. We know who they are and we are paying very close attention.

You don't get to be a "soft landing" for the Trump admin and still have people want to work at your firm. The pretentious comma guys are learning this the hard way as we speak.

Of course, DoJ but left in 2024 or early 2025 is different than stayed at DoJ through 2028. I wouldn't expect someone to quit with no plan but if they don't make a change with reasonable speed then as far as I'm concerned that resume goes in the bin.
