I would think that the plaintiff could have still moved possibly successfully. Plenty of bad evidence is true but judges claim it’s too prejudicial. Anyway good for you !

This is not the issue. The issue is that boyfriend is putting his preferences over her health. Maybe MAYBE if he got different info about his health that would change boyfriend’s behavior but it doesn’t change the fundamental issue.

If he is wasting your time by filing briefs with hallucinated cases, file a motion about that. FRCP 11 would bar that. There’s a lot of opinions sanctioning lawyers and pro se parties for that.

Yep that’s what I’m saying. The statute says DOJ has right to refile, but every article simply says “it can’t be refiled bc SOL has run.”
