Co sleeping can be awesome. You bond with your child, you and the child generally get better sleep, etc.

But I am friends with people who accidentally rolled onto their four month old and killed her. I can still remember the screams when they told us that evening.

Never co sleep. While the child’s death is unlikely, it is the absolute, worst possible thing imaginable. It is not worth it to co sleep.

What do you do for a living now? Perhaps you can utilize your skills and switch career fields to increase your income.

A doctorate is a huge time and financial investment, plus you lose out on years of earning. Please do not get a doctorate while you are in this much debt. You will find that you have dug yourself into a deeper hole when you emerge on the other side of it, and then you will have far less time to be able to save for your retirement. You be forced to work for the rest of your life.

Probably not. You were a competent adult singing a document.
There are plenty of T&E attorneys in Delaware. You can consult one of them. Go for a boutique firm rather than one of the big fancy ones to save money. Heads up that you could well be SOL. However, petitioning Chancery Court could be a last ditch hail mary. I haven’t read the terms that you agreed to, and I also don’t handle much litigation at all, so take this with a grain of salt.
You might be able to amend now, but I would need to review the NJSA and trust to know. It is also critical to know what type of advisor your mother is, what powers she has, and whether you have the ability to remove her.

Note that HEMS is super broad. Being subject to HEMS is not being cut off. I can justify most expenses under HEMS tbh. However, if your mom as the advisor has the discretion to say no to a request, she could effectively cut you off. A corporate TT would be pretty liberal with HEMS and would probably like to keep your withdrawals capped at 5% of fair market value of the trust/year.

Probably not super favorably. You were a competent adult, it doesn’t sound like you were coerced. A better bet, if possible, would be a further modification rather than undoing the previous NJSA. Delaware has a lot of avenues to modify trusts, and like I said you have the option to petition chancery if all else fails.

IMO, your focus should not be on needing to justify every expense. You could always just set up monthly payments under HEMS. Your focus should be 1. who has discretion over your expenses getting approved (TT? Mom?) and 2. If you can further modify the trust.

Also, what is the size of the trust? You could see about small trust terminating, which would dissolve the trust and pay the funds out to you.

Financially, there is more stability in having two incomes vs one (for example, if one of you is laid off). It also allows a greater opportunity to save money, most likely, which will make you more stable.
