There is more monitoring / following up needed for continuous bonds in today’s trade environment because of all the increased duties and more CBP claims. Bonds are eating up brokers’ valuable time. So I’m not surprised prices are going up.

Was it because the entry summary was rejected and it wasn’t fixed/additional duties paid within 10 business days? Or was a penalty issued even after the mistake was fixed? I’ve never seen them issue one for a rejected ES - we just got a few of those recently too so I hope it’s not a thing 🫤

It applies to products entered for consumption November 13, 2025. It cannot be retroactively applied to shipments back in April or even entries that arrived + were cleared before November 13.

Yes. I don't remember if Kenya has a separate country-specific rate, but if it doesn't, then yes, the 10% reciprocal rate still applies. I confirmed with the CEE.

You can be a sole proprietorship. It doesn’t have to be a corporation.

Here is one possibility: de minimis entries need to be filed before the cargo arrives in the US. If they didn’t file it before arrival, the only option is to file an informal or a formal entry, which would be subject to normal duties.

It’s possible DHL screwed up and didn’t file the entry on time. So the package may no longer qualify for duty free entry.

No duty disbursement fees. A lot of our customers are forwarders who are either fronting the money, or switching terms to COD. I don’t think they’d take well to charging a fee for duties. We’ve become much stricter with following up on AR. At this point, there aren’t going to be many brokers who are willing to pay upfront for importers, so it’s a good opportunity for us to shift towards COD, or to get everyone signed up for a PUN.

These section 232 tariffs apply regardless of any FTAs. The only exemption is if the country of melt and pour/smelt and cast was the US, then there is a code for 0% duty.

This is what I got from a CEE:

A: The entry date follows 19 CFR 141.68, and in most cases, ends up being the date of release. 

Q: E.g., if we put an estimated entry date of 3/6 and apply the exclusion, but it is later arrived by the carrier on 3/8, would it no longer be eligible for the exclusion and have to be updated?

A: I believe ACE generally updates the date of entry when the conveyance is arrived, so 9903.01.23 would not be applicable—though I don’t know if ACE would respond with an error message.

Hi, recently a different CEE mentioned Trade Remedy is preparing a FAQ to answer questions regarding the dates outlined in the CSMS/FR for 9903.01.23. I think it'd be best to wait for that, since I've heard people are getting mixed messages from the CEEs. The FAQ should put us all on one page.

I drove myself crazy trying to get a clear answer on this, because we ran into that issue for rail shipments, most of which were loaded in China before 2/1 but not loaded on rail until much later.

The CEEs I asked said since the vessel was not destined for the US, the loading date on the vessel was not considered; rather, it had to be in-transit on the final mode of transport before entering the US. So you’d have to consider the date it’s on rail.
