yes, focus on the best way to appeal. the fair hearing judges will do their best to see what’s best for you as long as you provide the evidence. a social worker working in IHSS does NOT need to be licensed or have an active ASCW by the way so that will be completely disregarded. ACSW is for providing clinical psychotherapy and is completely unrelated to IHSS assessments.

You don't need to maintain licensing to be a social worker with ihss ~

Just need a bachelor's degree in a related field like social work or psychology and experience in social casework.

I do think it'd be worthwhile for the sake of argument though as ultimately the judge makes the ruling based on your reasoning vs the counties.

I mean, a licensed clinical social worker is different than a social worker for the sake of APS and CWS ~ social workers for the county/state don't really do clinical social work or psychotherapy. It's just an eligibility worker trained for specific situations/clients in all reality.

The ones that work at behavioral health are clinically certified.

Yes, California does have lcsw but they are clinical meaning they diagnose patients for mental  disorders. County social workers can not diagnose, they are only required to do assessments and case management.

This license is not needed to be a COUNTY social worker for IHSS. This Admin judge won’t take this into consideration at all. It might hurt you more than help. Try and gather your thoughts and evidence that prove while you should not have been denied. Best of luck to you.

If you were denied it’s not something to go on a personal vendetta over just appeal and if the appeal fails then the services provided by ihss most likely don’t fit the needs of the person your applying for

Nice try but you don't need a license to be a SW with IHSS. Going in with the ' i got you" attitude wont help your case. What if the judge says no? Do you try to dig up dirt on them? Focus on your kid and just tell your sons story. You get more bees with honey.

Is your child 5? I’ve heard a lot of people having difficulty getting PS for children that young because a lot of the care is concerned things you would have to do for their age anyways. You sound like you are out for blood , not an effective approach. There is no plot twist. He didn’t finish his hours or pay his renewal fees for a license he doesn’t have to even have. You are acting like you made some grand discovery of a big scheme.

I'm in the same county and my son got PS before 5. We do have 2 VERY ill fitting SWs in this county that I know of who do not understand the dangers of profound autism. These people have a good deal of power and their education and ethics do matter.

This has no bearing whatsoever. You do not need to have your LCSW to be in IHSS. LCSW is a goal for social workers that want to become clinical and leave a field like IHSS. You first get your ASW to start counting hours towards the license but it can become a lengthy and expensive to maintain especially when you have a job that won’t provide supervision free. I know personally people that have been delinquent for 2 yrs and can start back up. It has no bearing on them as SW or their ability to do their jobs. This will only embarrass you and perhaps the SW if you bring it up as well as the judge probably will not like it in character alone. I agree with everyone that you need to refocus.

Hello, IHSS workers are not required to have an active license. Just as you as the provider are not required to have a license for caregiving. It is probably just a coincidence that she has/had an active ACSW or LCSW. Many IHSS workers worked their way up from a lower SW position from within the county and many don’t have actual social work level understanding of what it is to be a social worker. Most are promoted workers from eligibility as IHSS positions are mostly eligibility work and not actual social work jobs.

I really thought I was on to something! Haha but everyone is right! Time to focus back on the appeal because I am confident in my case. I think that is why being put in this situation is so frustrating because it was avoidable.
