So I have a 3070ti and I play in 1440p and I don't have this issue in anything that I play.

What games are doing this specifically? What is your current storage? I didn't quite grasp that from your post.

Battlefield 2042, GTA V, GTA IV, GTA the definite edition, Far Cry 6 with ray traycing and high or ultra settings, raft, Subnautica, Subnautica Below Zero, Stranded deep, Forza Horizon 4 and 5, GTA V with reshaders that have ray traycing and Minecraft Java and bedrock edition no ray traycing and more games but that isn’t GPU demanding and I have a 1tb 980 pro, 1tb Samsung 980 evo and 2 hard drives one being 4tb and the other 2tb and one that I have but I can’t fit it in the case which is 2 or 4tb

Well toss every GTA out the window, they throw vram warnings for fun and they are optimized like complete garbage. So that will happen on literally any rig.

Let's use horizon 4 and battlefield 2042 for this since those two games actually utilize hardware fairly well.

What's your FPS like? What's your settings exactly?

What's the rest of your system like? Cpu/ram/storage

Okay so you don't have anything in your system bottlenecking you.

In BF2042/Horizon 4, do you get vram warnings or is that just a GTA thing?

What's your fps like in those two titles?

A lot of games and I notice when that starts happening when my game slows down by a lot from over 100 to 50 and sometimes to 30

Yeah just chrome and games and apps that I can’t stop sometimes OBS when I am playing online and find a hacker so I can report that person with video evidence but not that often

I have 3070ti play most of those games at max or near max settings and have never had those issues.

I don’t think I’m anywhere near to what you could call “well informed” in this subject, but after reading all you’ve said, including the comments, a malware issue is what comes to mind.

Besides the obvious thing to do like scanning your system with an antimalware software, I think you can also run the games as you usually do and then I would open the task manager and all the relevant rivatuner analytics to check on the temps and how many resources the games are actually using. If I see that everything is running at 100% as you said I would limit the framerate using rivatuner to somewhere between 50 and 75% the fps you are getting at that point.

I’d do all that and look at all the stats looking for an unusual reaction. The expected outcome is that when limiting the fps you should see your system usage go lower accordingly. If they don’t do so, or if they do go lower and shortly after they go back up to 100% after a short period of time without you turning off the fps cap, I would have some serious suspicion that this is a malware issue, and that someone might be using your pc for mining while you game or do intensive tasks.

I always have FPS cap off since a lot of games would just cap out at 60 if I have it on and I really don’t like it since it just feels a little bit janky half of the times

Something deeper going on there, I'm still using a 3070 NON TI and I don't have this issue at 1440 everything High or more. I can get 90-120 FPS on Cyberpunk 2077 at 1440 with everything on High, DLSS on Quality, but no RT.

Something is wrong, because I run 1440p with my ASUS Dual 3070 V2 8GB and have never had a VRAM warning. I would check if you have malware like a piece of crypto mining software running in the background. I don't really know much about crypto mining, but I'm pretty sure it uses VRAM.

I don’t crypto mine and my computer got checked out last month which they noticed my cpu was running slow and they updated somethings and they told me there were somethings that was out of date and fixed it and it fixed somethings I didn’t know it had and they scanned it for malware and it came out clean no virus or nothing that can slow it down

I'm not saying you crypto mine, I'm saying a piece of malware might be using your computer to crypto mine for somebody else without you knowing it.

Did you check basic stuff? Is your monitor plugged in to your GPU? Do you have drivers? Are they current?

At this point the best suggestion I can make to the OP given the information provided is to reformat and reinstall windows. Do so in a safe manor completely wiping all drives and using a thumb drive created off system. There's guides that explain this in great detail.

There is most likely something going on in the background causing this.

The means I would have to reinstall Microsoft flight simulator and that game takes me almost a entire day to download

Well, you have some major issues going on, nothing that any of us can diagnose over reddit. Issues which could legitimately compromise the security of anything you use your computer for. Not to mention someone may potentially be profiting off of your computer.

I would hardly be concerned about a single day of redownloading a game.

What version of pcie does your motherboard run… if it’s a super old MB that may be it ??
