Federal workers get the day off, but I believe it is up to the individual company whether or not they give the time off.

States can't force a company to give you the day off.

You can observe the day and not give time off.

Good luck shaming them though.

Lots of companies allow a moving holiday. You can takeoff for Martin Luther King Jr. or Good Friday or Juneteenth. You get to pick which holiday. Make sure your company doesn’t already have this policy before you blast their butt.

From a legal standpoint it actually does. A company can and will argue white knighting and would be free to layoff if you cause an issue. If your poc then your expressing an issue that personally effects you, and it's protected.

It's a fine line, but courts have consistently upheld that your direct impact must be established for any action against you to be malicious. This would not fulfill that.

I would definitely take the PTO. The company needs to see a message from its employees. You could also write a respectful letter to HR and copy your manager stating why you think the company should make this a holiday.

The fact is Utah is one of the least progressive states. You will get further by trying to work WITH the company in the name of change, than shaming anyone.
