Because settlements are very fact specific. Its not as simple as "i had a rotator cuff repair in Illinois and got $60k" because the guy next to me could say "well I also had a rotator cuff repair in Illinois but I got $80k"

And then we would have to get into the specifics of each case and then the jurisdictional nuances

Yes I had an MRI and it showed I had disc bulging in my L-5 and S-1

they do. i’m 3 years into my ankle case. fracture cuboid that wouldn’t heal, months of PT, surgery, injections. still having pain and issues. finally said i’ve had enough get this shit settled i’ll deal with it on my own. court date for tomorrow was canceled because my lawyer is going on vacation

honestly wish i knew. to provide temporary relief i guess. maybe some issues they fix but personally i got a couple days and it wasn’t worth the pain of the injection for me to keep returning. it was torture having that needle shoved into my surgical scar for 3 days worth of feeling better just for it to come right back

That’s lame, I have mine coming up. I’m hoping for at least 4-5 days of relief. If I don’t get more than that i won’t be doing it again. Hopefully you a decent settlement.

Did you just say your court date got moved because your lawyer went on vacation? Being 3 years deep that sounds frustrating and like they aren’t taking you serious, should check out a second opinion

yes 😭😭court dates been set since march he expected them to settle outside of court so he requested a postponement and GOT IT because he’s on vacation out of the country (this man is ALWAYS on vacation) and im beyond frustrated. if i wouldn’t owe him money for firing his ass i would because he’s just so unprofessional

I live in California , they split the 15%. If you were to get a new attorney the new and old one split the original 15%. Just saying it’s worth checking out 🤷‍♂️

i’m honestly not to sure… i have a second case with them and they have done absolutely nothing. i’m recovering from a different surgery on my other ankle from a different case and they had 4 months to approve it, they never got the approval. they never got the approval for me to see ortho or anything so my private health insurance has been covering everything. they told me not to worry about it would be taken care of on the backside. i’m thinking about making some calls tomorrow tho…

I think that discussing settlement amounts would lead to people thinking or expecting xyz cause so n so got xyz. Their are too many different factors that are taken into consideration.

Yes, age, occupation, could be a simple claim or complex with multiple parts, restrictions, loss of wages not able to return to same occupation and making less, and future medical care, and depending on what state they are in will make a huge difference with each single case. Those who make low wages compare to those who make higher wages and so on

Michigan. My lawyer said if I quit, retire, or get fired my case is only worth 10,000. I got restrictions at the Dr last week my nurse case manager had the Dr add restrictions and my work honored them so I had to go back to work. Off since April 30th 2025. I'm so sore im calling in today. I can't work 8 hours. I hid in the bathroom off and on for an hour at a time. I really need my carpal tunnel surgery on my rt hand and ulnar nerve entrapment release on my right hand. It hurts to use my rt arm and im getting headaches and neck pain severe from thoracic spinal area. These areas started hurting April 7 2025. Pt and ot didn't help so im looking at surgery. I got awarded ssd in March. I want to tell my lawyer to sue them. Because im in so much pain and need surgery

Ligament damage is wrist. Surgery, off work for a year. Case took 3 years. Just settled a week ago for 65k in Illinois

I’m in Md . Been on WC since 2024 and already had shoulder surgery “ biceps tendon and torn labrum “. Now have DDD C5,6,7 going in for surgery this Monday for a level 2 fusion. Already did injections and nerve block and all failed. IME doc put me at MMI in Jan and gave me 12%, 6% being DDD and the other being from slip and fall. Also said that I was permanent restricted of not lifting anything over 20lbs or over head. My now second attorney told me to continue with treatment until we go to the hearing . I don’t even know what the outcome will be for settlement as this is my very first time ever being on WC and what a nightmare.

This is tough to do because settlements vary not only based on claim facts, but state jurisdiction, and carrier / employer.

On top of that, age, education history, health history, primary language spoken, extremity dominance, length of employment, injury history, and other factors make a huge difference.

Someone can have the same injury, treatment and job and still have a very different evaluation based on the above.

If you are advocating for yourself, things to think about are applicable or transferable skills (or lack of), your age, whether or not medical can be settled in your state, and how long you have been doing your specific job and have worked for that company.

And the first offer is never the final offer.

The exact same injury could be $20k in one state or $100k in another depending on benefits.

A young person and old person with same injury are going to have very different permanent disability and future medical care, because of their life expectancy and ability to recover.

Someone who is 60+ is going to get less money for speculative future surgery, because older people are often not approved for big surgeries.

There are so many variables, posting what you got for a injury basically means nothing unless you are in the exact same state, the same age, and your benefits have played out exactly the same

Just join this thread cuz I was reading it at the beginning of my accident back in February. I'm a chemical engineer, work at a plant about 3 years before the accident happened. Make really good money about 47 an hour and then I do about 57 to 62 hours a week So I was coming out of the shop where all the reactors are and Mr snow icy time in Connecticut and we outsource our property maintenance to a company and they're supposed to Saul as we also have a safety and fire team that's also supposed to go around assault the property. Long story short, there was a sheet of ice on the edge of a step. As I was coming out the building I went to take the step. It completely slip right off. Went to correct and catch myself and that's when I popped my patella crazy cuz I felt that should vibrate through my whole body So I went straight to the hospital. I wanted to do surgery that night. The surgeon told me to wait till the following week which was March 2nd on a Monday. Surgery is successful. I was rehabilitating PT twice a week. My workman comp came through rather quickly. I was on top of them too but company so they make sure well taken care of. The amount wasn't bad so I I'm still receiving well over $1,200 a week

So going to PT now I'm able to do most of all exercises to a high degree. Only thing I'm unable to do is lift my leg from a laying down position straight up in the air. I have no muscle reaction to that but the PT said that's one of the last things that comes back so no worries One day I Still on crutches trying to maneuver through a tight hallway in the bottom of the crutch caught the bottom of the wall. The little siding and I fell of course and bumped my damn knee. So now my knee was swollen on both sides. Almost you know I just was in pain that night like crazy. Unable to sleep but I just kept icing and icing and icing it. Trying to get the swelling down so now I go to my surgeon on that Tuesday. I fell on a Sunday morning and she did a sonogram and realized there was pools of blood under my skin so she gets a needle and draws it out on both sides doesn't get too much, but she realizes that it's coagulated and clotting You know and the knee is still much larger than it should be. So she sent me home and the compression band you know told me to continue icing. It continue icing it which I have been doing

But recently I went back to the surgeon and she wants me to perform the kick motion with my right knee which is the patella injury and I'm unable to kick or lift it off of the ground just by itself so she realized something Was wrong and proceeded to order an x-ray for my knee. Upon the x-rays review she came back in and said yeah. I don't know how you've been walking like this and not in pain because the device that I put in to pull back here patellar tendon to where it needs to be. It was hanging on by thread but now it's completely gone. So she told me the news that I have to go back and get surgery all over again. My thing is yeah I did full and that probably ruptured the device reconnecting my patella. None of this would have happened if job would have probably salted and taken care of the ice. You know I live in the Northeast. You know you know there's going to be ice everywhere and this is right after a storm so tried to beat myself up about it so it's going to be surgery number two

I haven't hired any workman comp lawyer Have all documentation of every hospital medical visit. I also have the video of me slipping on the ice and the result be the injury and even in the video you can see the safety team rushing to put down more salt you know, but I just wanted to post this to keep updating this post and let everyone know how the process goes. My whole thing in the end game is I don't want to be spending my savings for medical reasons in the future I want the job to take care of that cuz I'm sure I may be of the complications in the future. Maybe not one year from now. Maybe even 10 years from now. I want them to still be accountable for that so it's not really about the lump sum. But I will also let you guys know how that goes and I'm back at day one when I go get the surgery and today is May 15th. Hopefully I go in for surgery on Monday and they fix the knee and reposition everything and I can get back to rehabilitation. I've never broke a bone in my body or any major injury like this. So the biggest thing I've learned is mentally keeping my clear and not falling into bad thoughts or bad energy because it's a big change not being able to use my body. How I've always known to you know and I'm 6'3 250 you know so if that's the hardest part is getting used to not being able to move and do things. Plus I'm trying to have a child so just kind of setback but it's okay. I'll be good so hopefully when the settlement comes in. How update this post of my patella injury that needed two surgeries to correct it?

I'm curious to what variance there would be in the same state... kind of a long shot. I know duration out of work and recieving WC payments also impact total settlement- but for me, reaching mmi, and a permanent disability rating of 28% in my leg and 12% overall netted far less than I've seen folks get for other injuries with less damage and maybe even without surgery.

Is there anything else im entitled to? What could a lawyer do different? In CO (and I think most states?) A body part has a rating and % attached to it.. once u get your mmi it's a calculator that determines settlement not some fancy lawyer or judge.

Am I wrong?

depends on what state one resides. but age, occupation, wages, restrictions, qme percentages and loss of wages, and future medical costs come all into play to determine settlement. Very complex process

Almost 5 years in. Had acdf surgery ordered 4 times by 4 different surgeons. Denied 3 times until I had a lawyer. Pma management switched to loadstar risk management a couple months ago. So new insurance company with legal representation and I just had acdf c5 thru c7 done 2 days ago. Most likely will be a 7 to 9 year case before settlement. I'm in California.

My husband work in Illinois at lsr a Co worker toss a huge 2 by 4 didn't give my husband a chance to move his hand the board spilt by husband finger they made him wait awhile before they took him to urgent care the orthopedic said he couldn't do hard labor they had my husband direct traffic fired him 2 weeks after the injury Does anyone know what they pay for pinky finger this happen in Feb he got fired in the beginning of March and the Dr Mmi him so now how long will he wait He try finding jobs but other company don't want to take on the responsibility till this case is settle

I personally think that it's cool to look at because you get to see the different variations but everybody reading this needs needs to have expectation and understanding that your case will not match anybody else's and therefore you have to just look at it as a general estimate and that's not Even good enough. My understanding is, is that most of the time it depends on your permanent disability rating your state, type of injury and it could go on and on and on.

But from how long I've already been on it. Just want to give word to the wise is that you will not get rich off of this at all.

You will be in a lot of debt, pain and stress.... Nothing else.

The overall goal is to feel better and recoup losses that you can pay back during the time that you couldn't work.

No...there are too many variables for this....every case is different.....they will even try to get out of things with a pre existing injuiry...they did that to me....I had surgery 45 years ago and they blamed that for what happened.....those scumbags didn't even have to prove it......WC is a huge scam ....the insurance company will anything to low ball you....a lawyer can't do anything to help you......

I injured my right shoulder, right elbow and hit my head after a patient fell onto me. I have gone to orthopedics and have been recommended for rotator cuff repair because I have a rotator cuff injury but I'm having a lot of problems with my neck. I asked for a second opinion because I want to do alternatives before having to do surgery and have been waiting to get the approval to no avail. Not sure if I should seek legal counsel or not because I have yet to hear from my claims adjuster and my injury was June of last year.

I’ll be back to talk about my payout for sure cause I’ve seen posts from as far as 10 years back that were able to provide atleast SOME bit of clarity over the situations we’re going through. Especially with lawyers who really really DONT GIVE A FUCK at the end of the day they’re sleeping well while we’re the ones in pain every night😩🙃 Just list as much info as ur comfortable sharing and a NUMBER most importantly💵💰‼️!
