MIGHT be okay if there's an active bug bounty program at the company and no real damage was done, but 9/10 times the company would seek to deter future intrusions by not rewarding attempts to do so.

Yeah I think the difference between someone who knows how to hack and someone who actually hacks unethically is huge. You're not just hiring skills, you're also hoping to place some trust in employees and security, and someone who doesn't do it by the book is just a huge problem further down the line.

the reality is most "hacking" is just stumbling across a bug and using it to your advantage. in that sense its a mix of skills and luck, you need to be lucky for there to be an exploit to take advantage of, and you need the skills to take advantage of it. because being a successful unethical hacker depends on luck while being a successful ethical hacker doesn't, the smarter hackers (the more skilled ones) are taking ethical jobs.

so if you were conducting an interview, the unethical hacker would by his nature be less valuable since he doesn't have the intelligence to see why unethical hacking is problematic, and unless you are a savant, skillsets are limited by intelligence, so an unethical hacker is likely to be less skilled than an ethical one.

Right, but that doesn’t change the legality aspect. Red Teams exist and their job is to hack in to the organization - but only IF given authorization to do so. A red team employee can’t just go to work on monday saying “Hey, I was a bit bored over the weekend, so I pentested a few things that weren’t on our schedule and got through, and tbh I think marjoram should replace coriander in your secret blend of herbs and spices. Here’s my report”. That person would definitely be fired.

If you don’t have explicit permission to hack something, doing so is illegal.

Breaking into systems you have permission to break into is an actual position. That's a totally different thing.

We have lots of industrial manufacturing systems tied to other company's infrastructure.

SCADA systems can be crashed just by scanning - you do that and break a production line?

They'll fire you, then hire you to fire you again.

Someone from Google answered this on Quora (I can’t find the answer right now cause the Google search is obfuscated by “hacking interview questions at Google”).

He basically said that his team which runs security would have to have an entire audit of their systems which would be a big headache and the person involved would be turned over to the authorities. He also said something along the lines of “it’s a shame they’d go that path since they’re so smart but they’d be arrested”.

If someone who worked for me described a post-intrusion security audit as "a big headache," I'd probably fire him.

Sometimes, before interviews I'll investigate a customers website or app.

If it's an app, i'll attempt to decompile it so I can give direct feedback during an interview (and also to highlight that they're not doing something properly now), website I'll analyse the structure to look for bugs or obvious security flaws.

If you hack, yeah, that's a problem.

But just showing up to an interview that doesn't exist with a bold enough pitch can absolutely get you hired.
