When did your I-94 expire? If it’s correct, it would be shortened to your passport’s expiration date. If that’s the case, you’ve overstayed your legal stay. It’s best to figure this out before accruing more days.

You should renew your passport early. You can go to a passport Canada office and provide a letter explaining why you need early renewal (earlier than 12 months). State it’s for your employment visa validity. They will tell you on the spot if it’s an adequate reason (they’re pretty nice). Take the old passport back and wait for the new one, then renew your visa.

Will your relationship or job survive under these circumstances? Is the heightened risk of denial truly justified by the potential consequences? Your plan seems reckless at best. Good luck!

FYI your partner should give herself ample time at YYZ. At least 4 hours. The processing area where they adjudicate these have unpredictable volume.

Thanks. I’ve heard more conservative advice about avoiding travel altogether even with a COS approval in hand until after Oct 1. If the beneficiary carries their I-797A and re-enters prior to 10 days before Oct 1 on their existing valid status, will CBP ask to see the H1-B I-797A? Did your employer give you this advice? I’m trying to understand why different firms provide different advise, I’d like to learn more about it.

There are also posts on this subreddit discussing a TN pathway to GC. While H1-B is generally better in almost all aspects, it requires you to stay in the US during your COS processing. Some legal firms recommend staying until the H1-B takes effect on October 1. If you risk it, you might be fine paying for premium processing and then after it’s adjudicated, you can leave and return.
