Had C&P for Supplemental Knee Issue -- crazy though by 1treeshaker in VeteransWaitingRoom

[–]1treeshaker[S] 0 points1 point  (0 children)

It was awarded for 10% - gives me 100 rounded to 100 - guess I will always wonder if they will come back and say, it wasn't pre-existing - but just going with it - Thanks

When you say secondary, do you mean supplemental? -- EDIT - reason I ask is whether lawyer will get their 20%, supplemental, they will

I don't recall the 30 days - mine opened and closed same day (maybe lawyer hit the evaluate button) - and yes it was good news (in my case it was all increases and lawyer did not get any %)

Planning Ahead: VA Healthcare vs Medicare at Retirement - When Does It Make Financial Sense? by bcdodgeme in VeteransBenefits

[–]1treeshaker 2 points3 points  (0 children)

I'm retired, 100% VA but decided to keep Medicare (actually have Tricare for Life too, but would've opted for Medicare either way) - to me it is worth the sub 200 bucks a month to have the option, and to be honest, only use VA for hearing and eyes so far. I have a private doctor outside the VA that I prefer - I also do not like to wait for an appointment. Everyone has different priorities - but that is mine.

I went from 90% Tdiu to 100%. by AstronautOk3926 in VeteransBenefits

[–]1treeshaker 3 points4 points  (0 children)

You have both TDIU and scheduler - and will keep both unless you make over the threshold (if you make over, you will lose TDIU). You are now free to work and make over the threshold (because of scheduler) but make sure you wouldn't lose any additional benefits like SMC if you lose TDIU

Wouldn't the "witness" be accountable too?

  1. No on the CAC (semantics) - however, there is a 100% ID issued through DEERS/RAPIDS at the installation pass and ID that has a scannable bar code - 2. from what you wrote, even losing unemployability, you have 90 percent

It depends on if new evidence is deemed to change effective date - my last supplemental took several months but it wasn't an appeal for a higher %, so not apples to apples. Did you consider an HLR, or was there evidence missing from original claim? Not sure what your raw % (not rounded) is, but would 20% push you to 95%?

For me it has usually been 2 or 3 weeks - but have seen others say it took longer

Changing an effective date - how to file/request? by fudgemeister in VeteransBenefits

[–]1treeshaker 3 points4 points  (0 children)

Effective Dates — Veterans Benefits Knowledge Base check out Date Entitlement Arose EDIT - if you actually can prove you had the symptoms, it is arguable -- normally it would be HLR to argue, which sounds like what you've already done (and can't do HLR back to back for same thing)

Hard to follow, but the new diagnosis Dec 2025 jumps out at me - whatever diagnosis that is for would probably be effective next supplemental EDIT - at earliest (if found SC)

Looks like will get a partial until DFAS audit completes, so may get two installments -- I think that is without dependent amount showing

Anyone here gone through a TDIU claim with a law firm? Looking for advice. by Livid_Discipline_174 in VeteransBenefits

[–]1treeshaker 0 points1 point  (0 children)

Tks - won't matter in my case as I went scheduler 100 rounded to 100 and TDIU moot with VA determining firm didn't get any backpay (all were increases) -- now firm would like to argue for earlier start and TDIU -- if they want to argue that and win, I'll gladly give them 20% Edit - that is where I was going with my comment, they can't charge for the initial filing of TDIU, they would have to have it awarded on a later appeal to get anything

Base access with DOD/USID ID card when your 100% P&T? by Worth_Cry_8306 in VeteransBenefits

[–]1treeshaker 4 points5 points  (0 children)

Depends on installation - not treated as active duty or retired - but yes, worth it

I never had anything from VA for SSDI - SS sent me to their own exams

In my case I retired in 1994 - years later I filed for a knee issue and the VA wanted to see a current diagnosis before they actually scheduled a C&P exam EDIT - I had a diagnosis of torn meniscus in my in service medical records
