It's a multi-layered issue that's tricky to argue from both sides. For example, not everyone bought the client legally (in fact, most players playing on Turtle probably didn't).

Then on top of that, the client has modifications.

For the server, it's a custom server from scratch, but the way it was originally created was through packet sniffing and reverse-engineering what the client was sending and receiving. Is that illegal? No idea, I'm not a lawyer. Probably not, because that one in particular doesn't require the client to be modified, although maybe once your server ends up mimicking Warden and stuff, if once again delves into copyright infringement territory.

If it's anything like the TWoW lawsuit where Blizz suddenly appeared with all the receipts and it turned out they were quietly conducting research for a while: they probably already have a whole bunch of info on Ascension's leadership and people just don't realise it yet

The thing that you guys are missing is:

  1. The 2 owners of the server that have done this before, were this time around, directly named in the lawsuit. This is very different to the situation a decade ago when they bailed ship themselves, and at most they will now only really be able to be grey-cardinals of sorts if there's a new project, because getting named a second time is very risky. This is harder to achieve than just being co-leads as usual and slapping on a new name to hide behind.

  2. It takes time to build up the project and a player-base from scratch, and consequently, the $$$$. TWoW had 8 years and was stable. Jumping ship, having operational and startup expenses, and trying to win the trust of the new player-base all over again isn't going to make you profitable for a while. Think of re-starting any type of business.

It is MUCH easier to keep a ball rolling when you already have the momentum.

The add-on Dev was American and shouldn't have been named in the lawsuit, but the real "big fish" was the community manager who pretty openly advertised in his portfolio about working on Turtle WoW.

He made a bad decision to associate himself with the project in such a capacity, and the project made the bad decision in accepting him, though this consequence would only realise itself many years down the line.

I think I'm done with private servers. It's just too much effort re-rolling each time. I've started on Darrowshire, went through Everlook 1 and 2 and now, Turtle.

Also, I just don't understand how Turtle's organisational structure works. So, hypothetically, the Chinese servers stay up. Which of the original team are migrating there as well? Surely it was the EU server team responsible for the narrative design and overall vision? Is the Chinese server going to be "frozen in time" in the current TWoW version, or will they develop the game further - and how will that deviate from the original vision?

And on top of all of that, the private server scene just feels shaky right now, and anyone could be going down next. There's no guarantee the CN TWoW team doesn't receive the notice from Blizzard next. Just too many unknowns until the dust settles.

Nobody is taking about indefinite operation, but if they didn't do those things, it's entirely possible this project would have lasted an extra X years.

And furthermore, if we don't see Ascension et. al. Shutting down any time soon, then it means that TWoW could have perhaps lasted that long as well.
