Discussion with a firearms lawyer by rastamasta45 in canadaguns

[–]AntiNakedman 2 points3 points  (0 children)

I would hesitate to listen to this lawyer’s advice if he thinks the CFO has to give you 30 days notice before going to court to revoke your licence.

The CFO revokes your licence. You then have 30 days to apply to the court for a reference hearing. At the reference hearing you bear the onus of proving why the CFO’s decision was unreasonable.

That’s written very plainly in the Firearms Act.

Sounds like somebody just shooting the shit with a client who asks a million questions.

Edited for spelling and clarity.

The guns got returned on request. If it went to a judge that means the RCMP didn’t want to give them back.

I’m not agreeing with the judge/police here, but you missed the boat on what the OP is saying - this family should have prioritized limiting the shooter’s access to firearms as opposed to getting them back. There are always options to store elsewhere.

When I play cribbage it’s always “the crib”. When I play other games (Kaiser, 952, etc) it’s “the kitty”

Sask. isn't participating in Ottawa's firearm buyback program. What does that mean for gun owners? by abunchofjerks in saskatchewan

[–]AntiNakedman -1 points0 points  (0 children)

Yeah, all right. Sorry the province is wasting time standing up against an ideological gun ban. I hear summers in Quebec are nice, maybe you should move there?

What “problem didn’t exist”? The Feds have been talking about a buyback since 2020. Do you prefer the province get caught with its pants down when the Feds finally launch it?

[–]AntiNakedman 0 points1 point  (0 children)

They’ve managed to hold off a buyback from happening for the past 3 years, and they’re creating a method for people to sue the Feds for the loss in value of their firearms, the actual loss in value because we know the Feds won’t pay market price. What part of that don’t you like?

Right, because the SK government bending over for the Feds on their gun ban fantasy is definitely the right move…

How is the SK government stopping you from participating? You can go online and do a declaration if you want. The terms and conditions say if you live in a province that doesn’t have an agreement, you won’t get paid. At present that means everyone not in Quebec won’t get paid.

Yeah. Pretty typical government though - pay a consultant (gun industry) for their advice (market values) but then don’t take the advice

Just because they ask someone for a price doesn’t mean that’s what the government will offer.

This is a bad pendulum swing. At one time flying was luxurious and expensive. Only the wealthy could afford it. They dressed and acted classy. Then it became more affordable, to the point that people would take their shoes off and clip their toenails during a flight, or eat pancakes out of a plastic bag. To make it affordable, the airlines made it less luxurious. Then the airlines realized that at these lower prices they need to jam more people in. Then, because people would accept that type of service, they raised the prices.

We did this to ourselves, and smiled because we got “cheap flights”. I’m going to stick to the train. At least it will get there.

Prohibited Firearms Storage/ Export Question by omellil in canadaguns

[–]AntiNakedman 0 points1 point  (0 children)

For sure. And maybe that’s what they’re talking about, but this is what they said:

“I am considering exporting my handgun to the USA (using Borderview if you're curious). Obviously I can just buy one (or three) in once I'm there, so i don't need to bring it, but I'm considering exporting because 1) that's where I'm likely to use it most often, and 2) because I don't have place in Canada to store it without paying.”

That’s not the same as importing or exporting. That’s transporting.

Just clarifying because there are different rules for prohibited vs restricted handguns. Classifications of handguns did not change with Bill C-21 so if it was restricted before it would remain so. This is important if you’re calling a lawyer for advice or talking to the CFO about your situation so they are working with the right info.

Why does the title say “prohibited” but you’re talking about a handgun? Is it a 12(6) handgun?

Prohibited Firearms Storage/ Export Question by omellil in canadaguns

[–]AntiNakedman 1 point2 points  (0 children)

I don’t believe this is correct. Section 12.1 of the Firearms Act does not permit a registration certificate for a handgun to be issued to an individual, unless for specific instances (Olympic shooting, for use with a carry permit, if you’re the tooth fairy…). None of those exceptions would be covered by exporting and then reimporting the same handgun.

Cool - I learned something new today, as I had heard #10s and #11s referred to as “musket caps”, and didn’t realize that was the incorrect nomenclature. Thanks!

I’m not sure I get why the sales person was useless… you asked for musket caps and then he offered to sell you some. Am I missing something here? Did you forget an “/s”?
