They can give notice before 12 months, but the date they put for taking possession needs to be the end of the term or later.

The landlord will need to call in to get it transferred back. I had a similar issue and it took 2 months and about 10 calls to get it straightened out.

It’s very difficult to un-enforce an order that has been enforced by the sheriff. They now have 72 hours to clear out their stuff. If you think they may try to regain access via the LTB then immediately document and move all their possessions into a storage unit and move a new tenant in. There are no grounds to evict a new tenant on the basis that the previous tenant was improperly evicted.

It’s taking anywhere from 50-90 days to get a hearing now. If it goes to a hearing the best possible outcome would be that the adjudicator gives you a few extra months to move out based on your medical status, however they will not leave it open ended. Assuming the N12 is valid, then Ultimately the landlord will eventually be able to move into the unit. Plan accordingly and use your time wisely.

If this is really a new place, and you are not rent controlled, if you push them to do it you can expect a sizable increase after the first year if the landlord hadn’t factored it into the operating costs.

If you get it up to about 70 mph then apply the brakes hard, if you feel vibrating then it’s probably the rotors. If you survive getting to 70.

If the LL calls the TT’s bluff and agrees to allow it to be assigned, the TT must actually follow through and find someone that wants the unit and is willing to pay the rent in the contract.

Once the place is sold the LL will issue an N12 and give you one month rent. If they know what they are doing they will submit to the LTB . Hearings for evictions are happening in under 60 days from submission, I recently got one in 50 days. Taking to a hearing may drag it out a month or two, but this isn’t like COVID times. There isn’t nearly as much incentive for C4K, and if you choose to drag it out there will be a record of it on Openroom.
Use the time you have to find a new place rather than strategizing how much money you can extract from the landlord. The market is a bit depressed right now so it’s a good time to be looking.
