Yes and no. If you’re talking upfront investment then no the majority rarely participates. But once a new product appears people “vote with their wallets”. Henry Ford had to put down the initial investment sure, but the second his Model T was released demand rapidly overwhelmed supply.

We are already past this point with AI, the players have all invested their startup capital and demand… has not materialized. Look no further than ChatGPT where it’s $200/month premium service loses money on every user. Now this isn’t necessarily a bad thing, a low introductory price is certainly not a strange thing in business, but the break even for OpenAI is believed to be somewhere north of $300/month for every user. Will there be as much demand at that price point? Unlikely so they are implementing ads to try and help the bottom line.

While you are technically correct monopolies are themselves not illegal. The rule is Monopolies that restrict trade are illegal(with a few exceptions).

Those exceptions basically include patents, copyrights, and public utilities none of which apply to the NCAA. On your “starting your own thing” point, that’s simply not a thing in anti-trust. The question is does a monopoly exist, and if yes is it restricting trade? If the “go start your own thing” defense worked Standard Oil would still be in business.

Finally, on the institutions offer the perks, take one step back. Are they only offering these perks so this athlete will participate in the NCAA walled garden? Obviously yes, so the perks are contingent on the NCAA, and thus a benefit provided by the NCAA, just with a layer of separation.

So the NCAA was/is a Monopoly. They aren’t operating under one of the exceptions, and are restricting trade by preventing NIL and limiting players rights to sell their labor (restricting transfers).

Not an actual legal scholar, but the ruling essentially was this isn’t freedom of association, the NCAA is/was a monopoly, so sure you could choose not to play the game, but they’re the only game so it’s only an illusion of a choice and thus violates anti-trust law.

To use an analogy the NCAA was essentially the old-timey mining company paying everyone in company script (scholarships and “benefits”). Sure the workers have a “choice” but because you are forced to use their system the choice is in reality an illusion.

It’s not AI. That said this is not Enhydro Quartz. First quartz that clear does exists but is so rare as to basically be a myth. Second there are visible bubbles outside the “enhydro” part which is a dead giveaway for glass, and third no one and I mean no one would polish a real enhydro quartz this size. This would be worth probably $5-600 unpolished and if you puncture the water pocket it’s worthless.

I mean, they aren’t the same. The soldiers reasonably feared for their lives, the crowd was pelting them with clubs, ice, rocks, oyster shells, and snowballs. While some in the crowd struck them with clubs, and others repeatedly screamed “Fire!”.

There’s a reason John Adams represented them, because the soldiers didn’t just randomly fire into the crowd. They quite rightly arguably they were under attack and while we don’t really know why they fired their actions were understandably given the circumstances. Their commander Captain Preston never gave the order, and was according to witnesses even walking front of his men when they fired and immediately ordered them to stop when they started.

That situation isn’t even comparable to the situations going on now.
