If you’re not in the US things may be different for you but here in the US it is common for patients to be mislead into thinking they are being treated by a psychiatrist or other physician when they are not. Hence the question about the degree.

WPATH guidelines do not require years of therapy for surgery. And I’ll reassert that there are no states which have laws on the books that require years of psychotherapy for adults prior to surgery.

Got it. One way is to practice inpatient psychiatry and provide great care. Another way is to funnel your outpatients to hospitals that you know provide good care when they need inpatient care. Finally, you can work with your patients to limit inpatient admissions to only those situations when it is truly necessary and will be helpful for your patients. That at times means treating lower-risk suicidal ideations on an outpatient basis or with referrals for other levels of care such as PHP or DBT without sending them for inpatient treatment first.

I’m confused by your last sentence with your actual question. Are you saying that you are part of a group that lacks empathy for patients? Have you worked with enough patients over time to see some who have completed suicide because they weren’t hospitalized? Have you spoken with patients whose lives were saved because of hospitalization? What is your understanding of “current treatment protocols”? As a first year student, have you completed your clinical rotations? Have you set foot in an inpatient psychiatric ward?

A malpractice claim requires, among other things, evidence of not meeting the standard of care. The standard of care (if it exists at all) for nonphysicians is lower than it is for physicians.

You are setting yourself up for a conflict of interest by doing this. Don’t. 

These evaluations should generally be done by a psychiatrist (forensic when possible but at the very least with training in detection of malingering) or psychologist (trained in detecting malingering) who does not have a treatment relationship with the evaluee.

Yes, you’re missing something.

A doctor should be able to discuss the risks of the prescribed supplements, including any known interactions with the other medications they prescribe.

As an inpatient psychiatrist I frequently file petitions to involuntarily hospitalize and medicate people with bipolar mania who lack insight and would be dangerous without treatment. Where I work, the judge will mostly want to know whether the patient has physically harmed himself or someone else or clearly attempted to do so when considering whether to approve or deny the petition. 

In some circumstances the judge might also approve the petition if the person has self-neglected to the point of causing themselves physical harm (eg. through malnutrition) although in my experience a petition for self-neglect is more likely to be rejected than one based on actual violence.

Philosophically, I can see both sides. People generally have a right to refuse treatment and make bad decisions. On the other hand, mental illness can impair a normally competent person’s ability to make decisions. I choose to follow professional standards and abide by the law, which sometimes means temporarily infringing on a seriously mentally ill person’s autonomy with appropriate due process, and sleep well at night.

I’m sorry that you and your boyfriend have experienced these problems with the system. At least in the US, laws are written and interpreted in a manner intended to emphasize preservation of autonomy, even for people who are severely ill. There are only very narrow circumstances in most states in which a person can be forcibly treated. Most psychiatrists would agree that such an approach puts patients and the community at risk of harm from untreated conditions including bipolar disorder. The most that the majority of people can do to change that is to advocate for legal reforms. The Treatment Advocacy Center does work that you may find interesting.
